1 1 Section 1. NEW SECTION. 123.29A PROHIBIT THE SALE OF
1 2 ALCOHOLIC BEVERAGES FOR CONSUMPTION ON THE PREMISES WITHIN
1 3 CITIES.
1 4 A city council may enact an ordinance to prohibit the sale
1 5 of alcoholic beverages for consumption on the premises of
1 6 liquor control licensees or beer or wine permittees within the
1 7 city. If the ordinance is enacted, a liquor control licensee
1 8 or beer or wine permittee holding a valid license or permit to
1 9 sell alcoholic beverages for consumption on the premises
1 10 within the city may continue to sell the alcoholic beverages
1 11 for consumption on the premises until the license or permit
1 12 expires as provided in section 123.34 or is otherwise
1 13 suspended or revoked pursuant to this chapter or rules adopted
1 14 pursuant to this chapter.
1 15 EXPLANATION
1 16 This bill authorizes a city council to prohibit the sale of
1 17 alcoholic beverages for consumption on the premises of
1 18 licensees and permittees within the city. Liquor control
1 19 licensees and beer and wine permittees holding valid licenses
1 20 or permits when the ordinance is adopted may continue to sell
1 21 alcoholic beverages for consumption on the premises until the
1 22 license or permit expires or is otherwise suspended or revoked
1 23 for a violation of chapter 123.
