1 1 Section 1. Section 455B.103A, subsection 1, Code 1995, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. h. Before final approval is given for a
1 4 general permit to discharge stormwater, the department shall
1 5 request the assistance of a local representative of the United
1 6 States soil conservation service to evaluate the impact of
1 7 soil erosion and sediment accumulation at the point of the
1 8 stormwater discharge. The findings of the evaluation shall be
1 9 made available to the owners of the land adjacent to the point
1 10 of stormwater discharge.
1 11 EXPLANATION
1 12 This bill provides that, before the department of natural
1 13 resources issues a general permit for a stormwater discharge,
1 14 the department shall request the assistance of the United
1 15 States soil conservation service to evaluate the impact of
1 16 soil erosion and sediment accumulation at the point of the
1 17 stormwater discharge. The findings of the investigation are
1 18 to be made available to the owners of land adjacent to the
1 19 point of the discharge.
