PAG LIN 1 1 Section 1. Section 2A.1, Code 1995, is amended to read as 1 2 follows: 1 3 2A.1 COMMISSION ESTABLISHED. 1 4 A commission on compensation, expenses, and salaries for 1 5electedelective state officials is established and is 1 6 referred to in this chapter as "the commission". The 1 7 commission is composed of fifteen members, five of whom shall 1 8 be appointed by the governor, five of whom shall be appointed 1 9 by the majority leader of the senate, and five of whom shall 1 10 be appointed by the speaker of the house of representatives. 1 11 Members of the commission shall be appointed without regard to 1 12 political affiliation and shall not be state officials or 1 13 employees, employees of any state department, board, 1 14 commission, or agency or of any political subdivision of the 1 15 state. 1 16 Sec. 2. Section 2A.4, Code 1995, is amended to read as 1 17 follows: 1 18 2A.4 MEETINGS &endash; DUTIES. 1 19 The commission shallelect its own chairperson from among1 20its membership and shall meet on the call of the chairperson1 21 meet at least once every two years in order to fulfill the 1 22 commission's requirement to review compensation and expenses 1 23 received by members of the general assembly and salaries of 1 24 the other elective state officials. The commission shall 1 25 elect its own chairperson and vice chairperson from among its 1 26 membership who shall serve, so long as they remain members of 1 27 the commission, until at least the first meeting of the 1 28 commission following the meeting in which the commission makes 1 29 its recommendations. The commission shall meet upon the call 1 30 of the chairperson, upon the call of the vice chairperson if 1 31 the chairperson is no longer a member of the commission, or 1 32 upon the call of a majority of the members of the commission. 1 33 The commission shall review compensation and expenses paid to 1 34 members of the general assembly and salaries paid to other 1 35 elective state officials, and shall review compensation, 2 1 expenses, and salaries paid for comparable positions in other 2 2 states, the federal government, and private enterprise. Based 2 3 on such review and other factors deemed relevant, the 2 4 commission shall make its determination as to compensation and 2 5 expense levels for members of the general assembly and as to 2 6 salary levels for other elective state officials to be 2 7 recommended to the governor and the members of the general 2 8 assembly.No later than February 1, 1973, and each two years2 9thereafter, theThe commission shall report to the governor 2 10 and to the general assembly its recommendations for 2 11 compensation and expenses for members of the general assembly 2 12 and for salaries for other elective state officials no later 2 13 than April 10, 1995, and each two years thereafter. However, 2 14 the commission shall not make recommendations for compensation 2 15 and expenses prior to the date all collective bargaining 2 16 agreements between the state public employer and state 2 17 employee organizations, as referred to in section 20.17, 2 18 subsection 10, are completed either through agreement or 2 19 arbitration, in the year in which recommendations are 2 20 required. 2 21 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 22 immediate importance, takes effect upon enactment. 2 23 EXPLANATION 2 24 This bill provides that the compensation commission for 2 25 members of the general assembly and other elective state 2 26 officials meet at least once every two years in order to 2 27 fulfill its requirement to make recommendations on 2 28 compensation and expenses to the governor and the general 2 29 assembly. The bill provides for the election of a chairperson 2 30 and vice chairperson who shall serve until the commission 2 31 meets following the meeting in which recommendations are made. 2 32 The bill provides that the commission can meet upon the call 2 33 of the chairperson, the vice chairperson, if the chairperson 2 34 is unable to call a meeting, or upon the agreement of a 2 35 majority of the members of the commission. 3 1 The bill also provides that the commission shall make its 3 2 recommendations no later than April 10, 1995, and each two 3 3 years thereafter, but that in no event shall the commission 3 4 make recommendations prior to the date in that year that the 3 5 collective bargaining agreements with state employees are 3 6 completed. 3 7 This bill takes effect upon enactment. 3 8 LSB 1355XS 76 3 9 ec/cf/24
