PAG LIN 1 1 Section 1. Section 262.1, Code 1995, is amended to read as 1 2 follows: 1 3 262.1 MEMBERSHIP. 1 4 The state board of regents consists of nine members, eight 1 5 of whom shall be selected fromthe state at large solely with1 6regard to their qualifications and fitness to discharge the1 7duties of the officea list of nominees submitted to the 1 8 governor by the regents nominating council. The ninth member 1 9 shall be a student enrolled on a full-time basis in good 1 10 standing at either the graduate or undergraduate level at one 1 11 of the institutions listed in section 262.7, subsection 1, 2, 1 12 or 3, at the time of the member's appointment. Not more than 1 13 five members shall be of the same political party. 1 14 Sec. 2. NEW SECTION. 262.3 REGENTS NOMINATING COUNCIL. 1 15 1. A regents nominating council is created which shall 1 16 consist of six members. The alumni association of Iowa state 1 17 university of science and technology, the alumni association 1 18 of the university of northern Iowa, and the alumni association 1 19 of the university of Iowa shall each, through their 1 20 presidents, appoint two members, subject to confirmation by 1 21 the senate, to serve six-year staggered terms on the council 1 22 beginning and ending as provided in section 69.19. 1 23 2. The council shall elect from among its members a 1 24 chairperson. Meetings shall be held at the call of the 1 25 chairperson. The chairperson shall give the members of the 1 26 council at least five days' written notice by mail of the time 1 27 and place of every meeting, except as to members who execute 1 28 written waivers of notice at or before the meeting or unless 1 29 the council designated the time and place of the meeting at 1 30 its last meeting. Members of the regents nominating council 1 31 are entitled to be reimbursed for actual and necessary 1 32 expenses incurred in the performance of their duties as 1 33 council members for each day spent attending council meetings 1 34 or training sessions called by the chairperson. Expenses 1 35 shall be paid from funds appropriated to the state board of 2 1 regents for this purpose. 2 2 3. Four members shall constitute a quorum and the 2 3 affirmative vote of four members shall be necessary for any 2 4 action taken by the council. Any vacancy on the council shall 2 5 be filled in accordance with the procedures for regular 2 6 appointments. A member is ineligible for a second six-year 2 7 term on the council. The council shall be bipartisan and 2 8 gender-balanced in accordance with sections 69.16 and 69.16A. 2 9 4. The regents nominating council shall make nominations 2 10 to fill vacancies in the state board of regents. Within sixty 2 11 days after receiving notice of a vacancy, the council shall 2 12 certify to the governor three nominees per vacancy, in 2 13 alphabetical order. The nominees shall be chosen upon the 2 14 basis of their qualifications and fitness to discharge the 2 15 duties of the office by an affirmative vote of a majority of 2 16 the full statutory number of council members. In choosing the 2 17 nominees, consideration shall also be given to fulfilling the 2 18 requirement that the state board of regents be bipartisan and 2 19 gender-balanced in accordance with sections 69.16 and 69.16A. 2 20 Nominees shall be residents of the state. Due consideration 2 21 shall be given to area representation in the selection of 2 22 nominees. A person serving on the council shall not be 2 23 eligible for nomination by the council as a regent during the 2 24 term for which the person was appointed to the council. 2 25 Absence of a council member or a vacancy on the council shall 2 26 not invalidate a nomination. 2 27 Sec. 3. Section 262.5, Code 1995, is amended to read as 2 28 follows: 2 29 262.5 SUSPENSION. 2 30 When the general assembly is not in session, the governor 2 31 may suspend any member so disqualified and shall appoint 2 32 another nominee, from the list submitted by the regents 2 33 nominating council, to fill the vacancy thus created, subject 2 34 to the approval of the senate when next in session. 2 35 Sec. 4. INITIAL COMMISSION. Notwithstanding section 2, 3 1 subsection 1, of this Act, one of the members selected by the 3 2 alumni association of Iowa state university of science and 3 3 technology shall serve a two-year term, and the other member 3 4 shall serve a four-year term; one of the members selected by 3 5 the alumni association of the university of northern Iowa 3 6 shall serve a four-year term, and the other shall serve a six- 3 7 year term; and one of the members selected by the alumni 3 8 association of the university of Iowa shall serve a two-year 3 9 term, and the other shall serve a six-year term. The initial 3 10 organizational meeting shall be called by the executive 3 11 director of the state board of regents. 3 12 EXPLANATION 3 13 This bill creates a six-member regents nominating council 3 14 to nominate three candidates for each vacancy for membership 3 15 on the state board of regents. The council members are chosen 3 16 by the alumni associations of the three state universities. 3 17 The bill provides that eight of the nine members of the state 3 18 board of regents shall be appointed by the governor from the 3 19 list of nominees submitted by the council. 3 20 Any vacancy on the council shall be filled in accordance 3 21 with the procedures for regular appointments. A member is 3 22 ineligible for a second six-year term on the council. The 3 23 council shall be bipartisan and gender-balanced. 3 24 Within 60 days after receiving notice of a vacancy, the 3 25 council shall certify to the governor three nominees. The 3 26 nominees shall be chosen by a majority of the council members 3 27 upon the basis of their qualifications and fitness to 3 28 discharge the duties of the office. In choosing the nominees, 3 29 consideration shall be given to fulfilling the requirement 3 30 that the state board of regents be bipartisan and gender- 3 31 balanced. Nominees shall be residents of the state and 3 32 consideration shall be given to area representation. Council 3 33 members are not eligible for nomination to the board during 3 34 their term of service on the council. 3 35 Members of the regents nominating council are entitled to 4 1 be reimbursed for actual and necessary expenses incurred in 4 2 the performance of their duties as council members from funds 4 3 appropriated to the state board of regents for this purpose. 4 4 The bill also provides for the terms of the initial council 4 5 members and for an initial organizational meeting to be called 4 6 by the executive director of the state board of regents. 4 7 LSB 1079SS 76 4 8 kh/jj/8
