  1  3           (COMPANION TO LSB 2636HH BY KLEMME)
  1  4 A Concurrent Resolution requesting the Legislative 
  1  5    Council to establish an interim study committee
  1  6    to review the "one-call" statewide underground
  1  7    facility notification system.
  1  8    WHEREAS, chapter 480 establishes a "one-call"
  1  9 statewide notification system designed to provide
  1 10 notification of excavations for the purpose of
  1 11 protecting underground facilities as well as
  1 12 protecting individuals who could be harmed by
  1 13 disruption of the underground facilities; and
  1 14    WHEREAS, the "one-call" notification system is
  1 15 dependent upon the participation in the system of
  1 16 every person owning or operating an underground
  1 17 facility in order to finance the system and protect
  1 18 persons and property; and
  1 19    WHEREAS, many of the goals of the "one-call"
  1 20 notification system have not been achieved, resulting
  1 21 in the introduction of a number of legislative
  1 22 proposals because of alleged inefficiencies and the
  1 23 failure to meet the expectations of the law as
  1 24 enacted; and
  1 25    WHEREAS, the "one-call" notification system may
  1 26 place an unfair financial burden upon current
  1 27 participants in the system while failing to achieve
  1 28 the expected goals of protection of people and
  1 29 property with a minimum of administrative complexity;
  1 30 NOW THEREFORE,
  2  1    BE IT RESOLVED BY THE SENATE, THE HOUSE OF
  2  2 REPRESENTATIVES CONCURRING, That the Legislative
  2  3 Council is requested to establish an interim study
  2  4 committee consisting of members of both houses of the
  2  5 General Assembly, as well as citizen members or
  2  6 advisory groups representing "one-call" members or
  2  7 persons knowledgeable or having expertise regarding
  2  8 the "one-call" system; and
  2  9    BE IT FURTHER RESOLVED, That the committee shall
  2 10 review current law, notification center procedures,
  2 11 the impact of the notification system upon "one-call"
  2 12 participants, and the intent of the law, for the
  2 13 purpose of developing recommendations relating to the
  2 14 "one-call" system; and
  2 15    BE IT FURTHER RESOLVED, That available private
  2 16 funds may be used for the employment of consultants or
  2 17 experts and for the payment of other costs associated
  2 18 with the study as determined by the committee with the
  2 19 approval of the Legislative Council and based on
  2 20 recommendations of appropriate advisory groups, and
  2 21 for which state funding is not otherwise available;
  2 22 and
  2 23    BE IT FURTHER RESOLVED, That the committee shall
  2 24 prepare a written report including any recommendations
  2 25 of the committee and including any recommended bill
  2 26 drafts designed to implement such recommendations, and
  2 27 deliver the report to the General Assembly by no later
  2 28 than January 8, 1996.
