PAG LIN 1 1 Amend Senate File 2470 as follows: 1 2 #1. Page 33, by inserting after line 23 the 1 3 following: 1 4 "Sec. . Section 513B.4A, Code 1995, is amended 1 5 to read as follows: 1 6 513B.4A EXEMPTION FROM PREMIUM RATE RESTRICTIONS. 1 7 1. A Taft-Hartley trust or a carrier with the 1 8 written authorization of such a trust may make a 1 9 written request to the commissioner for an exemption 1 10 from the application of any provisions of section 1 11 513B.4 with respect to a health benefit plan provided 1 12 to such a trust. The commissioner may grant an 1 13 exemption if the commissioner finds that application 1 14 of section 513B.4 with respect to the trust would have 1 15 a substantial adverse effect on the participants and 1 16 beneficiaries of such trust, and would require 1 17 significant modifications to one or more collective 1 18 bargaining arrangements under which the trust is 1 19 established or maintained. An exemption granted under 1 20 thissectionsubsection shall not apply to an 1 21 individual if the individual participates in a trust 1 22 as an associate member of an employee organization. 1 23 2. Two or more nonprofit organizations 1 24 incorporated pursuant to chapter 504A and formed for a 1 25 charitable purpose as defined in section 13C.1, 1 26 subsection 2, and not for the purpose of purchasing 1 27 insurance, may combine for the purpose of entering 1 28 into an agreement to purchase group health insurance. 1 29 The combination of organizations may elect to be rated 1 30 as a single group subject to both of the following: 1 31 a. Each organization becoming part of the 1 32 combination is eligible to obtain coverage that is 1 33 offered on a guaranteed issue basis. 1 34 b. Coverage purchased pursuant to this subsection 1 35 is subject to section 513B.10, subsection 3, 1 36 paragraphs "a", "b", and "c". 1 37 The agreement to purchase group insurance under 1 38 this subsection shall require that an organization 1 39 which participates in the group coverage shall not 1 40 withdraw from the group coverage for a period of five 1 41 years. The agreement shall also require that an 1 42 organization which withdraws from the group coverage 1 43 shall not be permitted to participate in the group 1 44 coverage for a period of five years after withdrawal." 1 45 #2.
