1 4 #1. Page 1, line 35, by striking the figure "3."
1 5 and inserting the following: "3 and inserting the
1 6 following:
1 7 "Sec. . It is the intent of the general
1 8 assembly that an energy supplier who has proceeded in
1 9 good faith under the terms and conditions of chapter
1 10 476 not suffer economic loss as a result of action or
1 11 inaction taken by the state. These persons shall be
1 12 reimbursed by the utilities for their reasonable good
1 13 faith costs as determined by the Iowa utilities board.
1 14 An energy supplier shall be deemed to have proceeded
1 15 in good faith if the supplier has made a written
1 16 request to the board by January 1, 1996, requesting
1 17 enforcement of the provisions of sections 476.43 and
1 18 476.44 by requiring an electric utility to enter into
1 19 a potential contract with the energy supplier and an
1 20 action is currently pending before the Iowa utilities
1 21 board.""
