  1  1    Amend the House amendment, S-5821, to Senate File
  1  2 2195, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  By striking page 1, line 5, through page 4,
  1  5 line 20, and inserting the following:
  1  6    ""Section 1.  There is appropriated from the
  1  7 general fund of the state to the Iowa communications
  1  8 network fund created in section 8D.14 for the fiscal
  1  9 year beginning July 1, 1996, and ending June 30, 1997,
  1 10 the following amount, or so much thereof as is
  1 11 necessary, to be used for the purpose designated:
  1 12    For debt service:  
  1 13 .................................................. $ 12,754,000
  1 14    Upon the appropriation of the funds in this section
  1 15 to the Iowa communications network fund, the Iowa
  1 16 telecommunications and technology commission shall
  1 17 immediately transfer $12,754,000 of the appropriated
  1 18 amount to a separate fund established in the office of
  1 19 the treasurer of state, to be used solely for debt
  1 20 service for the Iowa communications network.  The
  1 21 commission shall certify to the treasurer of state
  1 22 when a debt service payment is due, and upon receipt
  1 23 of the certification the treasurer shall make the
  1 24 payment.  The commission shall pay any additional
  1 25 amount due from funds deposited in the Iowa
  1 26 communications network fund.
  1 27    Sec. 2.  PART III RELATED APPROPRIATIONS.
  1 28    1.  PART III AUTHORIZED USERS.
  1 29    a.  There is appropriated from the rebuild Iowa
  1 30 infrastructure fund of the state created in section
  1 31 8.57, subsection 5, to the Iowa communications network
  1 32 fund under the control of the Iowa telecommunications
  1 33 and technology commission for the fiscal year
  1 34 beginning July 1, 1996, and ending June 30, 1997, the
  1 35 following amount, or so much thereof as is necessary,
  1 36 to be used for the purpose designated:
  1 37    For the connection of a minimum of 110 Part III
  1 38 authorized users as determined by the commission and
  1 39 communicated to the general assembly:  
  1 40 .................................................. $ 19,600,095
  1 41    b.  It is the intent of the general assembly that
  1 42 the connection of the authorized user sites pursuant
  1 43 to this subsection be awarded based upon the Part III
  1 44 contracts executed in 1995.
  1 45    c.  Notwithstanding the fact that funds
  1 46 appropriated pursuant to this subsection will not be
  1 47 made available prior to July 1, 1996, the Iowa
  1 48 telecommunications and technology commission is
  1 49 authorized to negotiate and enter into contracts for
  1 50 ordering necessary equipment related to the completion
  2  1 of the connections authorized in paragraph "a" as
  2  2 deemed appropriate by the commission upon the
  2  3 effective date of this paragraph.
  2  4    2.  PART III NETWORK COSTS – SUBSIDIZATION FUND.
  2  5 There is appropriated from the general fund of the
  2  6 state to the Iowa communications network fund created
  2  7 in section 8D.14 for the fiscal year beginning July 1,
  2  8 1996, and ending June 30, 1997, the following amount,
  2  9 or so much thereof as is necessary, to be used for the
  2 10 purposes designated in this subsection:
  2 11    For the subsidization of video rates for authorized
  2 12 users as determined by the commission and consistent
  2 13 with chapter 8D:  
  2 14 .................................................. $  2,400,000
  2 15 ............................................... FTEs      57.00
  2 16    3.  PART III NETWORK COSTS – MAINTENANCE AND LEASE
  2 17 COSTS.
  2 18    a.  There is appropriated from the rebuild Iowa
  2 19 infrastructure fund of the state created in section
  2 20 8.57, subsection 5, to the Iowa communications network
  2 21 fund under the control of the Iowa telecommunications
  2 22 and technology commission for the fiscal year
  2 23 beginning July 1, 1996, and ending June 30, 1997, the
  2 24 following amount, or so much thereof as is necessary,
  2 25 to be used for the purpose designated:
  2 26    For maintenance costs and recurring lease costs as
  2 27 provided in this subsection:  
  2 28 .................................................. $  1,199,905
  2 29    b.  As a condition of the appropriation in this
  2 30 subsection, $209,298 of the amount appropriated shall
  2 31 be expended by the Iowa telecommunications and
  2 32 technology commission for maintenance costs associated
  2 33 with Part III connections of the network.
  2 34    c.  As a further condition of the appropriation in
  2 35 this subsection, $990,607 of the amount appropriated
  2 36 shall be expended by the Iowa telecommunications and
  2 37 technology commission for recurring lease costs
  2 38 associated with Part III connections of the network.
  2 39    4.  SUPPORT SERVICES.  There is appropriated from
  2 40 the general fund of the state to the Iowa
  2 41 communications network fund created in section 8D.14
  2 42 for the fiscal year beginning July 1, 1996, and ending
  2 43 June 30, 1997, the following amount, or so much
  2 44 thereof as is necessary, to be used for the purposes
  2 45 designated:
  2 46    For purposes designated in paragraphs "a" and "b",
  2 47 and for not more than the following full-time
  2 48 equivalent positions:  
  2 49 .................................................. $  1,950,000
  2 50 ................................................FTEs       10.0
  3  1    a.  As a condition of the appropriation in this
  3  2 subsection, $450,000 of the amount appropriated shall
  3  3 be expended by the public broadcasting division of the
  3  4 department of education to provide support for
  3  5 functions related to the network, including but not
  3  6 limited to the following functions:  scheduling for
  3  7 video classrooms; development of distance learning
  3  8 applications; development of a central information
  3  9 source on the Internet relating to educational uses of
  3 10 the network; second-line technical support for network
  3 11 sites; testing and initializing sites onto the
  3 12 network; and coordinating the work of the education
  3 13 telecommunications council.  The division is
  3 14 authorized an additional 5.00 FTEs for a total of
  3 15 10.00 FTEs for the purpose of providing such support.
  3 16    b.  As a further condition of the appropriation in
  3 17 this subsection, $1,500,000 of the amount appropriated
  3 18 shall be allocated by the public broadcasting division
  3 19 of the department of education to the regional
  3 20 telecommunications councils established in section
  3 21 8D.5.  The regional telecommunications councils shall
  3 22 use the funds to provide technical assistance for
  3 23 network classrooms, planning and troubleshooting for
  3 24 local area networks, scheduling of video sites, and
  3 25 other related support activities.
  3 26    5.  SPARE PARTS.  There is appropriated from the
  3 27 rebuild Iowa infrastructure fund of the state created
  3 28 in section 8.57, subsection 5, to the Iowa
  3 29 communications network fund created in section 8D.14,
  3 30 for the fiscal year beginning July 1, 1996, and ending
  3 31 June 30, 1997, the following amount, or so much
  3 32 thereof as is necessary, to be used for the purpose
  3 33 designated:
  3 34    For establishing and maintaining a spare parts
  3 35 depot related to the network:  
  3 36 .................................................. $    220,000
  3 37    6.  COMPUTERS, INTERNET CONNECTION, AND RELATED
  3 38 COSTS.  There is appropriated from the rebuild Iowa
  3 39 infrastructure fund of the state created in section
  3 40 8.57, subsection 5, to the Iowa communications network
  3 41 fund created in section 8D.14, for the fiscal year
  3 42 beginning July 1, 1996, and ending June 30, 1997, the
  3 43 following amount, or so much thereof as is necessary,
  3 44 to be used for the purpose designated:
  3 45    For the purchase of computer equipment to be used
  3 46 in connection with the network, providing for
  3 47 connections to the Internet through the use of the
  3 48 network, and for maintaining the regional scheduling
  3 49 system:  
  3 50 .................................................. $    110,000
  4  1    Sec. 3.  There is appropriated from the general
  4  2 fund of the state to the Iowa communications network
  4  3 fund created in section 8D.14 for the fiscal year
  4  4 beginning July 1, 1996, and ending June 30, 1997, the
  4  5 following amount, or so much thereof as is necessary,
  4  6 to lease DS-1 or T-1 circuits for Part III connections
  4  7 currently using analog technology:  
  4  8 ...................................................$     65,000
  4  9    Sec. 4.  There is appropriated from the general
  4 10 fund of the state to the state board of regents for
  4 11 the fiscal year beginning July 1, 1996, and ending
  4 12 June 30, 1997, the following amount, or so much
  4 13 thereof as is necessary, to be used for the purpose
  4 14 designated:
  4 15    For the center for educational technology at the
  4 16 university of northern Iowa to coordinate staff
  4 17 development for educators using educational technology
  4 18 in this state:  
  4 19 .................................................. $    500,000
  4 20    Sec. 5.  LEGISLATIVE INTENT.
  4 21    1.  It is the intent of the general assembly that
  4 22 the Iowa telecommunications and technology commission
  4 23 develop recommendations concerning the expenses which
  4 24 should be recovered in the rates established by the
  4 25 commission for use of the network, and any necessary
  4 26 subsidies.  The commission shall file a written report
  4 27 concerning these recommendations with the senate
  4 28 committee on communications and information policy and
  4 29 the house of representatives committee on technology
  4 30 by no later than January 13, 1997.
  4 31    2.  It is also the intent of the general assembly
  4 32 that the education telecommunications council and the
  4 33 regional telecommunications councils give priority to
  4 34 network video usage during the normal school hours for
  4 35 grades prekindergarten through twelve at those video
  4 36 sites which are located within school district
  4 37 facilities.  The commission, in consultation with the
  4 38 education telecommunications council, shall establish
  4 39 a policy for flexibility of use for educational video
  4 40 classrooms during normal school hours for events
  4 41 unrelated to network use.
  4 42    Sec. 6.  CONTRACT MODIFICATION.  Notwithstanding
  4 43 section 8D.13, the commission is authorized to
  4 44 negotiate a contract with Sooland Cable involving the
  4 45 connection of five Part III sites, to provide for a
  4 46 lump-sum payment at the time of installation and
  4 47 activation of the circuit which will result in a real
  4 48 savings within a range of $23,400 up to $27,000 per
  4 49 site when compared to the original contract price.
  4 50    Sec. 7.  ADDITIONAL CONNECTIONS.
  5  1    1.  LEWIS CENTRAL HIGH SCHOOL.  Notwithstanding
  5  2 section 8D.13, subsection 5, the state may own and the
  5  3 Iowa telecommunications and technology commission
  5  4 shall provide for the construction and connection to
  5  5 the Iowa communications network of the Lewis Central
  5  6 high school, located in Council Bluffs and contiguous
  5  7 to the school for the deaf established under chapter
  5  8 270.
  5  9    2.  ADDITIONS TO PART III.  The Iowa
  5 10 telecommunications and technology commission may
  5 11 contract for construction relating to connections to
  5 12 the Iowa communications network for the following
  5 13 authorized users which were not identified in the
  5 14 original Part III request for proposals, but which
  5 15 meet the definition of a Part III user pursuant to
  5 16 section 8D.13, subsection 2, paragraph "c":
  5 17    a.  Wall LakeView middle school, Wall Lake.
  5 18    b.  Meservey-Thornton community school district,
  5 19 Thornton.
  5 20    c.  Eldora state training school, Eldora.
  5 21    d.  Iowa juvenile home, Toledo.
  5 22    e.  Four oaks educational center, Cedar Rapids.
  5 23    f.  Keystone area education agency, Dubuque.
  5 24    g.  Any other school district, identified by the
  5 25 commission, which does not have a connection to the
  5 26 network.
  5 27    Sec. 8.  EFFECTIVE DATE.
  5 28    1.  Section 2, subsection 1, paragraph "c", of this
  5 29 Act, which authorizes the Iowa telecommunications and
  5 30 technology commission to begin negotiations for
  5 31 ordering necessary equipment prior to the availability
  5 32 of funding, being deemed of immediate importance,
  5 33 takes effect upon enactment.
  5 34    2.  Section 7, subsection 1, of this Act, which
  5 35 authorizes the state to construct and own the Iowa
  5 36 communications network connection to Lewis Central
  5 37 high school, being deemed of immediate importance,
  5 38 takes effect upon enactment.""
