  1  1    Amend the Senate amendment, H-5922, to House File
  1  2 2458, as amended, passed, and reprinted by the House,
  1  3 as follows:
  1  4    #1.  Page 1, by inserting after line 2 the
  1  5 following:
  1  6    "#   .  Page 1, by inserting after line 16 the
  1  7 following:
  1  8    "Sec.    .  Section 216A.136, unnumbered paragraph
  1  9 1, as enacted by 1996 Iowa Acts, House File 2448,
  1 10 section 2, if enacted, is amended to read as follows:
  1 11    The division shall maintain an Iowa statistical
  1 12 analysis center for the purpose of coordinating with
  1 13 data resource agencies to provide data and analytical
  1 14 information to federal, state, and local governments,
  1 15 and assist agencies in the use of criminal and
  1 16 juvenile justice data.  Notwithstanding any other
  1 17 provision of state law, unless prohibited by federal
  1 18 law or regulation, the division shall be granted
  1 19 access, for purposes of research and evaluation, to
  1 20 criminal history records, official juvenile court
  1 21 records, juvenile court social records, and any other
  1 22 data collected or under control of the board of
  1 23 parole, department of corrections, district
  1 24 departments of correctional services, department of
  1 25 human services, judicial department, and department of
  1 26 public safety.  However, intelligence data and peace
  1 27 officer investigative reports maintained by the
  1 28 department of public safety shall not be considered
  1 29 data for the purposes of this section.  Any record,
  1 30 data, or information obtained by the division under
  1 31 this section and the division itself are subject to
  1 32 the federal and state confidentiality laws and
  1 33 regulations which are applicable to the original
  1 34 record, data, or information obtained by the division
  1 35 and to the original custodian of the record, data, or
  1 36 information.  The access shall include but is not
  1 37 limited to all of the following:
  1 38    Sec.    .  Section 216A.136, subsection 4, as
  1 39 enacted by 1996 Iowa Acts, House File 2448, section 2,
  1 40 if enacted, is amended to read as follows:
  1 41    4.  Criminal history and intelligence data
  1 42 maintained under chapter 692.""
  1 43    #2.  Page 1, by striking lines 3 through 7.
  1 44    #3.  Page 1, by inserting before line 8 the
  1 45 following:
  1 46    "#   .  Page 2, line 20, by striking the word
  1 47 "including" and inserting the following:  "including
  1 48 pursuant to guidelines established by the supreme
  1 49 court, except that the supreme court guidelines shall
  1 50 not apply where the person represented is charged with
  2  1 a class "A" felony.  Reasonable compensation
  2  2 includes"."
  2  3    #4.  Page 2, line 15, by striking the word
  2  4 "probation" and inserting the following:
  2  5 "incarceration".
  2  6    #5.  Page 2, by inserting after line 18 the
  2  7 following:
  2  8    "(4)  Prison with sentence reconsideration."
  2  9    #6.  Page 2, line 34, by inserting after the word
  2 10 "and" the following:  "sublevels one and three of
  2 11 level".
  2 12    #7.  Page 3, lines 14 through 16, by striking the
  2 13 words "or use twenty-one-day shock probation under
  2 14 subsection 1, paragraph "d", subparagraph (1),".
  2 15    #8.  Page 4, line 21, by striking the word
  2 16 "supervision" and inserting the following:
  2 17 "sanctions".
  2 18    #9.  Page 5, line 7, by striking the word
  2 19 "supervision" and inserting the following:
  2 20 "sanctions".
  2 21    #10.  Page 10, by inserting after line 3 the
  2 22 following:
  2 23    "Sec.    .  INDICTABLE MISDEMEANORS – STUDY –
  2 24 REPORT.  The state public defender shall conduct a
  2 25 study to determine which indictable misdemeanors
  2 26 should be reclassified as simple misdemeanors in order
  2 27 to reduce the need for and costs associated with
  2 28 appointed counsel in this state while balancing the
  2 29 rights of those persons charged with such crimes.  In
  2 30 conducting the study the state public defender shall
  2 31 seek input from as many individuals with knowledge on
  2 32 this issue as possible.  The state public defender
  2 33 shall submit a report of the study's findings and
  2 34 recommendations to the general assembly by January 13,
  2 35 1997."
  2 36    #11.  Page 10, by inserting after line 3 the
  2 37 following:
  2 38    "#   .  Title page, line 1, by inserting after the
  2 39 words "relating to" the following:  "criminal and
  2 40 juvenile justice, including criminal intelligence data
  2 41 and"."
  2 42    #12.  Title page, line 3, by inserting after the
  2 43 word "costs," the following:  "conducting a study on
  2 44 indictable misdemeanors,"."
  2 45    #13.  By renumbering, relettering, or redesignating
  2 46 and correcting internal references as necessary.
