  1  1    Amend Senate File 2140, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  By striking everything after the enacting
  1  4 clause and inserting the following:
  1  5    "Section 1.  Section 321.210, subsection 2,
  1  6 paragraph d, Code 1995, is amended to read as follows:
  1  7    d.  The first two speeding violations within any
  1  8 twelve-month period of ten miles per hour or less over
  1  9 the legal speed limit in speed zones having a legal
  1 10 speed limit between thirty-four equal to or greater
  1 11 than thirty-five miles per hour and fifty-six miles
  1 12 per hour.
  1 13    Sec. 2.  Section 321.285, subsection 6, unnumbered
  1 14 paragraph 1, Code 1995, is amended to read as follows:
  1 15    Notwithstanding any other speed restrictions, the
  1 16 speed limit for all vehicular traffic on fully
  1 17 controlled-access, divided, multilaned highways
  1 18 including the national system of interstate highways
  1 19 designated by the federal highway administration and
  1 20 this state (23 U.S.C.  } 103 (e)) is sixty-five miles
  1 21 per hour.  The speed limit for vehicular traffic,
  1 22 other than motor trucks, on the national system of
  1 23 interstate highways and on fully controlled-access,
  1 24 divided, multilaned highways is seventy miles per hour
  1 25 and the speed limit for motor trucks is sixty-five
  1 26 miles per hour.  However, the department or cities
  1 27 political subdivisions with the approval of the
  1 28 department may establish a lower speed limit upon such
  1 29 for highways located within the corporate limits of a
  1 30 city jurisdiction of the political subdivision.  For
  1 31 the purposes of this subsection, a fully controlled-
  1 32 access highway is a highway that gives preference to
  1 33 through traffic by providing access connections with
  1 34 selected public roads only and by prohibiting
  1 35 crossings at grade or direct private driveway
  1 36 connections.  A minimum speed of forty miles per hour,
  1 37 road conditions permitting, is established on the
  1 38 highways referred to in this subsection.
  1 39    Sec. 3.  Section 321A.3, subsection 4, Code 1995,
  1 40 is amended to read as follows:
  1 41    4.  The abstract of operating record provided under
  1 42 this section shall designate which speeding violations
  1 43 occurring on or after July 1, 1986, but before May 12,
  1 44 1987, are for violations of ten miles per hour or less
  1 45 over the legal speed limit in speed zones that have a
  1 46 legal speed limit greater than thirty-five miles per
  1 47 hour.  For speeding violations occurring on or after
  1 48 May 12, 1987, the abstract provided under this section
  1 49 shall designate which speeding violations are for ten
  1 50 miles per hour or less over the legal speed limit in
  2  1 speed zones that have a legal speed limit equal to or
  2  2 greater than thirty-five miles per hour but not
  2  3 greater than fifty-five miles per hour.
  2  4    Sec. 4.  Section 516B.3, subsection 1, Code 1995,
  2  5 is amended to read as follows:
  2  6    1.  The commissioner shall require that insurance
  2  7 companies transacting business in this state not
  2  8 consider speeding violations occurring on or after
  2  9 July 1, 1986, but before May 12, 1987, which are for
  2 10 speeding violations for ten miles per hour or less
  2 11 over the legal speed limit in speed zones that have a
  2 12 legal speed limit greater than thirty-five miles per
  2 13 hour or speeding violations occurring on or after May
  2 14 12, 1987, which are for speeding violations for ten
  2 15 miles per hour or less over the legal speed limit in
  2 16 speed zones that have a legal speed limit equal to or
  2 17 greater than thirty-five miles per hour but not
  2 18 greater than fifty-five miles per hour for the purpose
  2 19 of establishing rates for motor vehicle insurance
  2 20 charged by the insurer and shall require that
  2 21 insurance companies not cancel or refuse to renew any
  2 22 such policy for such violations.  In any twelve-month
  2 23 period, this section applies only to the first two
  2 24 such violations which occur.
  2 25    Sec. 5.  CONSTRUCTION AREA SAFETY STUDY.  The state
  2 26 department of transportation and the department of
  2 27 public safety shall study and prepare a joint report
  2 28 relating to vehicle speed management, enhanced speed
  2 29 limit enforcement, and work zone safety in
  2 30 construction areas.  The departments shall confer with
  2 31 representatives of the private sector construction
  2 32 industry to develop guidelines to promote motorist and
  2 33 construction worker safety.  The departments shall
  2 34 file the joint report with the general assembly by
  2 35 January 1, 1997.
  2 36    Sec. 6.  EFFECTIVE DATE.  This Act, being deemed of
  2 37 immediate importance, takes effect upon enactment."
  2 38    #2.  Title page, by striking line 1 and inserting
  2 39 the following:  "An Act relating to speed limits, by
  2 40 increasing the speed limit on certain highways,
  2 41 relating to speeding violations and license suspension
  2 42 and motor vehicle liability coverage, requiring".
