PAG LIN 1 1 Amend House File 2472, as amended, passed, and 1 2 reprinted by the House, as follows: 1 3 #1. Page 27, by inserting before line 35 the 1 4 following: 1 5 "Sec. . Section 232.22, subsection 6, Code 1 6 Supplement 1995, is amended to read as follows: 1 7 6. If the court has waived its jurisdiction over 1 8 the child for the alleged commission of a forcible 1 9 felony offense pursuant to section 232.45 or 232.45A, 1 10 and there is a serious risk that the child may commit 1 11 an act which would inflict serious bodily harm on 1 12 another person, the child may be held in the county 1 13 jail, notwithstanding section 356.3. However, 1 14 wherever possible the child shall be held in sight and 1 15 sound separation from adult offenders. A child held 1 16 in the county jail under this subsection shall have 1 17 all the rights of adult postarrest or pretrial 1 18 detainees. 1 19 Sec. . Section 356.3, Code 1995, is amended to 1 20 read as follows: 1 21 356.3 MINORS SEPARATELY CONFINED. 1 22 Any sheriff, city marshal, or chief of police, 1 23 having in the officer's care or custody anyprisoner1 24 person under the age of eighteen years who has not 1 25 been waived to criminal court for the alleged 1 26 commission of a forcible felony,shall keep such1 27prisoner separate and apart, and prevent communication1 28by such prisoner with prisoners above that age, while1 29such prisoners are not under the personal supervision1 30of such officer, if suitable buildings or jails are1 31provided for that purpose, unless such prisoner is1 32likely to or does exercise an immoral influence over1 33other minors with whom the prisoner may be imprisoned.1 34A person under the age of eighteen years prosecuted1 35under chapter 232 and not waived to criminal court1 36 shallbe confinedconfine the person in a jail only 1 37 under the conditions provided inchapter 232section 1 38 232.22. 1 39 A person under the age of eighteen years who has 1 40 been waived to criminal court may be confined in a 1 41 jail in accordance with section 232.22, subsection 6. 1 42 Any officer having charge of prisoners who without 1 43 just cause or excuse neglects or refuses to perform 1 44 the duties imposed on the officer by this section may 1 45 be suspended or removed from office therefor." 1 46 #2.
