  1  1    Amend Senate File 2385 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  NEW SECTION.  46.26  CONGRESSIONAL
  1  5 DISTRICT DEFINED.
  1  6    As used in this chapter, "congressional district"
  1  7 means those districts established following the most
  1  8 recent federal decennial census and described in
  1  9 chapter 40.
  1 10    Sec. 2.  Section 46.1, Code 1995, is amended to
  1 11 read as follows:
  1 12    46.1  APPOINTMENT OF STATE JUDICIAL NOMINATING
  1 13 COMMISSIONERS.
  1 14    The governor shall appoint, subject to confirmation
  1 15 by the senate, one eligible elector of each
  1 16 congressional district to the state judicial
  1 17 nominating commission for a six-year term beginning
  1 18 and ending as provided in section 69.19.  The terms of
  1 19 no more than three two nor less than two one of the
  1 20 members shall expire within the same two-year period.
  1 21 No more than a simple majority of the members
  1 22 appointed shall be of the same gender.
  1 23    Sec. 3.  Section 46.2, Code 1995, is amended to
  1 24 read as follows:
  1 25    46.2  ELECTION OF STATE JUDICIAL NOMINATING
  1 26 COMMISSIONERS.
  1 27    The resident members of the bar of each
  1 28 congressional district shall elect one eligible
  1 29 elector of the district to the state judicial
  1 30 nominating commission for a six-year term beginning
  1 31 July 1.  The terms of no more than three two nor less
  1 32 than two one of the members shall expire within the
  1 33 same two-year period, the expiration dates being
  1 34 governed by the expiration dates of the terms of the
  1 35 original appointive members.  The members of the bar
  1 36 of the respective congressional districts shall in
  1 37 January, immediately preceding the expiration of the
  1 38 term of a member of the commission, elect a successor
  1 39 for a like term.  For the first elective term open on
  1 40 or after July 1, 1987 1997, in the odd-numbered
  1 41 congressional districts four and five the elected
  1 42 member shall be a woman and in the even-numbered
  1 43 congressional districts one, two, and three the
  1 44 elected member shall be a man.  Thereafter, the
  1 45 districts shall alternate between women and men
  1 46 elected members.
  1 47    Sec. 4.  TRANSITION.
  1 48    1.  The term of the male commissioner who resides
  1 49 in congressional district one, as described in chapter
  1 50 40, and was elected to otherwise serve a term expiring
  2  1 on June 30, 1999, shall expire on April 30, 1996, and
  2  2 that commissioner shall not be replaced.  Any election
  2  3 to replace that commissioner held before the effective
  2  4 date of this Act shall be a nullity.
  2  5    2.  The term of the male commissioner who resides
  2  6 in congressional district three, as described in
  2  7 chapter 40, and was appointed by the governor to
  2  8 otherwise serve a term expiring on April 30, 2001,
  2  9 shall expire on April 30, 1996, and that commissioner
  2 10 shall not be replaced.  Any appointment made by the
  2 11 governor to replace that commissioner before the
  2 12 effective date of this Act shall be a nullity.
  2 13    3.  The terms of those commissioners appointed by
  2 14 the governor who reside in congressional district
  2 15 four, as described in chapter 40, shall expire on
  2 16 April 30, 1996, and the governor shall appoint one
  2 17 male commissioner for congressional district four
  2 18 pursuant to section 46.1, except that the term shall
  2 19 expire April 30, 1997.  Thereafter, governor's
  2 20 appointees shall serve six-year terms as provided in
  2 21 section 46.1.
  2 22    4.  The term of the commissioner who resides in
  2 23 congressional district four, as described in chapter
  2 24 40, and was elected to otherwise serve a term expiring
  2 25 on June 30, 1997, shall expire on April 30, 1996, and
  2 26 that commissioner shall not be replaced.  Any election
  2 27 to replace that commissioner held before the effective
  2 28 date of this Act shall be a nullity.
  2 29    Sec. 5.  EFFECTIVE AND APPLICABILITY DATES.  This
  2 30 Act, being deemed of immediate importance, takes
  2 31 effect upon enactment and applies to appointive terms
  2 32 ending on April 30, 1996, and thereafter, and to
  2 33 elective terms ending on April 30, 1996, and
  2 34 thereafter, as provided in this Act."
  2 35    #2.  Title page, by striking lines 1 through 3 and
  2 36 inserting the following:  "An Act relating to
  2 37 appointment and election of state judicial nominating
  2 38 commissioners and providing effective and
  2 39 applicability dates and transition provisions."
