  1  1    Amend Senate File 2100 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  Section 123.3, subsection 19, Code
  1  5 1995, is amended to read as follows:
  1  6    19.  "Legal age" means nineteen eighteen years of
  1  7 age or more.
  1  8    Sec. 2.  Section 137C.25C, subsection 3, Code 1995,
  1  9 is amended to read as follows:
  1 10    3.  The owner or operator reasonably believes that
  1 11 the individual is using the premises for an unlawful
  1 12 purpose including, but not limited to, the unlawful
  1 13 use or possession of controlled substances or the use
  1 14 of the premises for the consumption of alcohol by an
  1 15 individual in violation of section 123.47 or 123.47A.
  1 16    Sec. 3.  Section 321.216B, Code 1995, is amended to
  1 17 read as follows:
  1 18    321.216B  USE OF MOTOR VEHICLE LICENSE BY UNDERAGE
  1 19 PERSON TO OBTAIN ALCOHOL.
  1 20    A person who is under the age of twenty-one legal
  1 21 age, as defined in section 123.3, for the consumption
  1 22 of alcohol, who alters or displays or has in the
  1 23 person's possession a fictitious or fraudulently
  1 24 altered motor vehicle license and who uses the license
  1 25 to violate or attempt to violate section 123.47 or
  1 26 123.47A, commits a simple misdemeanor.  The court
  1 27 shall forward a copy of the conviction or order of
  1 28 adjudication under section 232.47 to the department.
  1 29    Sec. 4.  Section 805.8, subsection 10, paragraph a,
  1 30 Code Supplement 1995, is amended by striking the
  1 31 paragraph.
  1 32    Sec. 5.  REPEAL.  Section 123.47A, Code 1995, is
  1 33 repealed."
