1 2 #1. Page 3, line 7, by inserting after the word
1 3 "meeting." the following: "At least two requests for
1 4 proposals must be received before a governmental unit
1 5 may enter into a guaranteed energy cost-savings
1 6 contract."
1 7 #2. Page 4, by inserting after line 22 the
1 8 following:
1 9 "5. TAX-EXEMPT INTEREST. A governmental unit
1 10 contracting through an installment payment contract or
1 11 lease-purchase agreement may designate interest on the
1 12 installment payment contract or lease-purchase
1 13 agreement as tax-exempt if the governmental unit
1 14 complies with the tax-exempt reporting requirements of
1 15 the Internal Revenue Code. A state agency,
1 16 department, institution, legislative body, or other
1 17 establishment or official of the executive, judicial,
1 18 or legislative branches of this state authorized by
1 19 law to enter into contracts shall obtain the approval
1 20 of the treasurer of state and director of the
1 21 department of management before entering into a
1 22 contract and making such tax-exempt designation. A
1 23 college or university shall obtain the approval of the
1 24 state board of regents before entering into a contract
1 25 and making such tax-exempt designation. A technical
1 26 school shall obtain the approval of the department of
1 27 education and the treasurer of state before making
1 28 such tax-exempt designation.
1 29 6. AUDIT. The auditor of state, or a certified or
1 30 registered public accountant, shall, as part of the
1 31 audit of a governmental unit, independently audit the
1 32 energy or operational cost-savings of an energy cost-
1 33 savings measure under a guaranteed energy cost-savings
1 34 contract.
1 35 7. INDEBTEDNESS. A guaranteed energy cost-savings
1 36 contract shall be designated as long-term debt on the
1 37 balance sheet of the governmental unit, and shall be
1 38 included annually on the report to the treasurer of
1 39 state of indebtedness of the governmental unit.
1 40 8. HEARING. Prior to entering into a guaranteed
1 41 energy cost-savings contract, a local political
1 42 subdivision such as a county, city, public school
1 43 district, or public service or special purpose
1 44 district shall hold a hearing pursuant to section
1 45 73A.2.
1 46 9. CHAPTER 573. A guaranteed energy cost-savings
1 47 contract shall be subject to the provisions of chapter
1 48 573, and the contractor shall provide a bond as
1 49 provided in chapter 573.
1 50 10. ENERGY SAVINGS CALCULATIONS. Before entering
2 1 into a guaranteed energy cost-savings contract, a
2 2 governmental unit shall obtain verification by the
2 3 department of natural resources of the energy savings
2 4 calculations, which shall be available at the time of
2 5 the public hearing."
