1 2 #1. Page 2, line 21, by striking the word
1 3 "community." and inserting the following: "community,
1 4 approved in accordance with subsection 3.
1 5 3. The authority shall not enter into any
1 6 agreement with a municipality under this program
1 7 unless the project has been approved as follows:
1 8 a. The governing body of the city or county
1 9 containing the municipality shall hold a public
1 10 hearing on the proposed project not less than seven
1 11 days following the publishing of notice of the hearing
1 12 in a newspaper of general circulation in the city or
1 13 county in which the proposed project is to be located.
1 14 b. Following the public hearing, if the governing
1 15 body wishes to proceed with the project, the governing
1 16 body shall adopt a resolution approving the project.
1 17 The resolution shall provide for a reverse referendum
1 18 under paragraph "c".
1 19 c. Upon the petition of ten percent of the persons
1 20 who voted in the last election for members of the
1 21 governing body of the city or county, received within
1 22 thirty days of the date of adoption of the resolution
1 23 under paragraph "b", the governing body shall direct
1 24 that the proposal be submitted for a special election
1 25 to be held as early as practicable. Notice of the
1 26 election shall be given as provided in section 49.53,
1 27 for cities, or as provided in section 331.305, for
1 28 counties. The notice shall state the time and place
1 29 of holding the election and the hours when the polls
1 30 will open and close, the purpose of the election, and
1 31 a description of the proposed project. The project
1 32 shall be considered approved if a majority of the
1 33 votes cast favor the project."
