  1  1    Section 1.  Section 272.33, Code 1995, is amended to read
  1  2 as follows:
  1  3    272.33  EVALUATOR LICENSE.
  1  4    Effective July 1, 1990, in In addition to licenses required
  1  5 under rules adopted pursuant to this chapter, an individual
  1  6 employed as an administrator, supervisor, school service
  1  7 person, or teacher by a school district, area education
  1  8 agency, or community college, who conducts evaluations of the
  1  9 performance of individuals holding licenses under this
  1 10 chapter, shall possess an evaluator license or an evaluator
  1 11 endorsement appearing on a teaching or administrative license.
  1 12 Individuals employed in community colleges who do not directly
  1 13 supervise licensed teaching faculty are exempt from this
  1 14 section.
  1 15    By July 1, 1990, the The board of educational examiners
  1 16 shall adopt rules establishing requirements for an evaluator
  1 17 license or an evaluator endorsement including but not limited
  1 18 to renewal requirements, fees, and suspension and revocation
  1 19 of evaluator licenses or endorsements.  An approved program
  1 20 shall include provisions for determining that an applicant for
  1 21 an evaluator license or endorsement has satisfactorily
  1 22 completed the program.  The state board of education shall
  1 23 work with institutions of higher education under the state
  1 24 board of regents, private colleges and universities, community
  1 25 colleges, and area education agencies to ensure that the
  1 26 courses required under subsection 1 are offered throughout the
  1 27 state at convenient times and at reasonable cost.  The
  1 28 requirements shall include completion of a program approved by
  1 29 the state board of education as follows:
  1 30    1.  For evaluation of teachers, the development of skills
  1 31 including but not limited to analysis of lesson plans,
  1 32 classroom observation, analysis of data, performance
  1 33 improvement strategies, and communication skills.
  1 34    2.  For evaluation of licensed employees other than
  1 35 teachers, the development of skills including but not limited
  2  1 to communication skills, analysis of employee performance,
  2  2 analysis of data, and performance improvement strategies.
  2  3    A An evaluator license is valid for a period of five years
  2  4 from its issuance and is renewable upon meeting renewal
  2  5 requirements established by the board of educational
  2  6 examiners.  The holder of a license with an evaluator
  2  7 endorsement must complete evaluation coursework as part of
  2  8 license renewal requirements.  The board of educational
  2  9 examiners shall develop renewal requirements for holders of
  2 10 evaluator endorsements.  To be eligible for an evaluator
  2 11 license or evaluator endorsement, an individual must hold
  2 12 either a teacher's license or administrative license issued by
  2 13 the board of educational examiners.  An individual possessing
  2 14 a permanent teaching license which remains in force shall be
  2 15 issued an evaluator license.  
  2 16                           EXPLANATION
  2 17    This bill provides an alternative to obtaining an evaluator
  2 18 license for individuals employed in a supervisory teaching or
  2 19 administrative capacity.  Such individuals are currently
  2 20 required pursuant to section 272.33 to complete coursework
  2 21 leading to evaluator licensing if they are responsible for
  2 22 administering teaching faculty performance evaluations.  Under
  2 23 the bill an evaluator endorsement appearing on a teaching or
  2 24 administrative license would enable these individuals to
  2 25 coordinate expiration and renewal dates with their underlying
  2 26 teaching or administrative license, and simplify
  2 27 administrative recordkeeping.  They would be required to
  2 28 complete licensing-related coursework and conform to renewal
  2 29 requirements developed by the board of educational examiners.
  2 30 Individuals possessing permanent professional education
  2 31 licenses would continue to obtain an evaluator license, as
  2 32 opposed to an endorsement, upon completion of the required
  2 33 coursework.
  2 34    The bill also provides that individuals employed in
  2 35 community colleges who do not directly supervise licensed
  3  1 teaching faculty are exempt from the evaluator licensing or
  3  2 endorsement requirements.  
  3  3                      BACKGROUND STATEMENT
  3  4                     SUBMITTED BY THE AGENCY
  3  5    Currently, educators apply for an evaluator license at
  3  6 various times.  Some educators complete the necessary
  3  7 coursework, but since they are not employed in a position
  3  8 requiring the license, they do not apply for the license.
  3  9 When they do apply the license is issued for a five-year
  3 10 period.
  3 11    Under current law, it is not possible to issue the
  3 12 evaluator license for a term which is consistent with a base
  3 13 license (either a teacher's license or an administrative
  3 14 license).  This can cause confusion because the educator holds
  3 15 licenses with multiple expiration dates and renewal
  3 16 requirements.
  3 17    If there were an option for an evaluator endorsement, which
  3 18 would be placed on the base license, then the license and the
  3 19 endorsement would be renewed at the same time.  This would
  3 20 reduce the confusion for the educator and simplify the agency
  3 21 record system.
  3 22    The evaluator license would continue to be issued for those
  3 23 remaining educators who hold a permanent professional license.
  3 24 These licenses are no longer issued, but continue in force.
  3 25    These changes will simplify the licensing process for Iowa
  3 26 educators, and at the same time, the intent of the legislation
  3 27 would be maintained.  Also, the proposed changes do not deny
  3 28 or remove any privileges currently held by Iowa educators.
