PAG LIN 1 1 Section 1. NEW SECTION. 217.24 COMPULSIVE GAMBLERS 1 2 OUTPATIENT CENTERS – PROGRAMS – FUNDING. 1 3 1. As used in this section, "compulsive gambler" means a 1 4 person who is chronically and progressively preoccupied with 1 5 gambling and the urge to gamble. 1 6 2. A county or city in which an excursion gambling boat 1 7 has its home dock or in which a pari-mutuel racetrack is 1 8 located may establish a compulsive gamblers outpatient center. 1 9 The outpatient center shall provide services for compulsive 1 10 gamblers and their families. The department shall provide, by 1 11 rule adopted pursuant to chapter 17A, for the development and 1 12 administration of all programs for compulsive gamblers. The 1 13 department may administer the programs, directly or by 1 14 contract. A person or the family of a person requesting 1 15 services for compulsive gamblers from an outpatient center 1 16 shall prove by a preponderance of the evidence that the 1 17 person's chronic preoccupation with gambling and the urge to 1 18 gamble was exacerbated by the establishment of gambling games 1 19 on excursion gambling boats or at pari-mutuel racetrack 1 20 enclosures. 1 21 3. Funds for establishing a compulsive gambler outpatient 1 22 center and its compulsive gambling programs may be paid from 1 23 the gamblers assistance fund established pursuant to section 1 24 99E.10 and from other public or private funds. 1 25 EXPLANATION 1 26 This bill defines compulsive gambler as a person who is 1 27 chronically and progressively preoccupied with gambling and 1 28 the urge to gamble. The bill provides for the establishment 1 29 of compulsive gamblers outpatient centers in those cities or 1 30 counties where pari-mutuel racetracks or excursion gambling 1 31 boats are located. The department of human services is 1 32 directed to develop and administer, by rule, the compulsive 1 33 gamblers programs in the outpatient centers. The department 1 34 of human services may administer the program directly or by 1 35 contract. 2 1 The proceeds of the gamblers assistance fund and other 2 2 private or public funds may be used to fund the compulsive 2 3 gamblers outpatient centers and compulsive gamblers programs. 2 4 LSB 4291HC 76 2 5 tj/cf/24
