PAG LIN 1 1 Section 1. Section 321.194, subsection 1, Code 1995, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. c. Each person fourteen or fifteen years 1 4 of age issued a class C or M driver's license pursuant to this 1 5 section shall be the only occupant or rider of a motor vehicle 1 6 operated in accordance with paragraph "a", unless the person 1 7 occupying the seat beside the operator possessing a class C 1 8 driver's license is a person holding a valid motor vehicle 1 9 license who is the parent or guardian of the licensee, member 1 10 of the licensee's immediate family if the family member is at 1 11 least twenty-one years of age, an approved driver education 1 12 instructor, a prospective driver education instructor who is 1 13 enrolled in a practitioner preparation program with a safety 1 14 education program approved by the state board of education, or 1 15 a person who is twenty-five years of age or more if written 1 16 permission to accompany the licensee as provided in this 1 17 paragraph is granted by the licensee's parent or guardian. 1 18 EXPLANATION 1 19 This bill requires a person issued a special minors' 1 20 driver's license under section 321.194 to be the only occupant 1 21 of a motor vehicle or the only rider of a motorcycle operated 1 22 in accordance with paragraph "a", unless the person occupying 1 23 the motor vehicle seat beside the driver is a person issued a 1 24 valid motor vehicle license who is the parent or guardian of 1 25 the licensee, member of the licensee's immediate family if the 1 26 family member is at least 21 years of age, an approved driver 1 27 education instructor, a prospective driver education 1 28 instructor who is enrolled in a practitioner preparation 1 29 program with a safety education program approved by the state 1 30 board of education, or a person who is at least 25 years of 1 31 age if written permission is granted by the licensee's parent 1 32 or guardian. The section of the Code amended provides that 1 33 the department of transportation may suspend a special minors' 1 34 driver's license upon receiving satisfactory evidence that the 1 35 licensee has violated the provision amended by this bill. 2 1 Under section 805.8, the scheduled fine for a violation of the 2 2 provisions is $20. 2 3 LSB 4347HC 76 2 4 kh/jj/8
