1 1 Section 1. Section 19A.9, subsection 2, Code 1995, is
1 2 amended to read as follows:
1 3 2. For pay plans within the purview of an appropriation
1 4 made by the general assembly and not otherwise provided by law
1 5 for all employees in the executive branch of state government,
1 6 excluding employees of the state board of regents, after
1 7 consultation with the governor and appointing authorities with
1 8 due regard to the terms of collective bargaining agreements
1 9 negotiated under chapter 20 and after a public hearing held by
1 10 the commission. A pay plan not formulated pursuant to a
1 11 collective bargaining agreement between the state public
1 12 employer and state employee organizations, as referred to in
1 13 section 20.17, subsection 10, shall not compensate a state
1 14 employee at a rate lower than a state employee with similar
1 15 work-related responsibilities is compensated under a pay plan
1 16 formulated pursuant to such a collective bargaining agreement.
1 17 Review of the pay plan for revisions shall be made in the same
1 18 manner at the discretion of the director, but not less than
1 19 annually. The annual review by the director shall be made
1 20 available to the governor a sufficient time in advance of
1 21 collective bargaining negotiations to permit its
1 22 recommendations to be considered during the negotiations.
1 23 Each employee in the executive branch, excluding employees of
1 24 the state board of regents, shall be paid at one of the rates
1 25 set forth in the pay plan for the class of position in which
1 26 employed and, unless otherwise designated by the commission,
1 27 shall begin employment at the first step of the established
1 28 range for the employee's class.
1 29 EXPLANATION
1 30 This bill provides that a pay plan not formulated pursuant
1 31 to a collective bargaining agreement between the state public
1 32 employer and state employee organizations shall not compensate
1 33 a state employee at a rate lower than a state employee with
1 34 similar work-related responsibilities is compensated under a
1 35 pay plan developed pursuant to such a collective bargaining
2 1 agreement.
