1 1 Section 1. Section 455A.4, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 6. Before the environmental protection
1 4 commission adopts a rule, the director shall give notice to
1 5 the chairperson, vice chairperson, and ranking member of the
1 6 committees of the general assembly which have jurisdiction
1 7 over environmental issues. The notice shall be given at least
1 8 thirty-five days in advance of the submission of the notice of
1 9 intended action under section 17A.4, subsection 1, and shall
1 10 include a statement of either the terms or substance of the
1 11 intended action or a description of the subjects and the
1 12 issues involved.
1 13 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 14 immediate importance, takes effect upon enactment.
1 15 EXPLANATION
1 16 This bill requires that before the environmental protection
1 17 commission adopts a rule, the director of the department of
1 18 natural resources shall give notice to the chairperson, vice
1 19 chairperson, and ranking member of the committees of the
1 20 general assembly which have jurisdiction over environmental
1 21 issues. The notice shall be given at least 35 days in advance
1 22 of the submission of the notice of intended action under
1 23 section 17A.4, and shall include a statement of either the
1 24 terms or substance of the intended action or a description of
1 25 the subjects and the issues involved. The bill takes effect
1 26 upon enactment.
