  1  1    Section 1.  Section 321.285, subsection 6, unnumbered
  1  2 paragraph 1, Code 1995, is amended to read as follows:
  1  3    Notwithstanding any other speed restrictions, the speed
  1  4 limit for all vehicular traffic on fully controlled-access,
  1  5 divided, multilaned highways including the national system of
  1  6 interstate highways designated by the federal highway
  1  7 administration and this state (23 U.S.C.  } 103 (e)) is sixty-
  1  8 five miles per hour.  The speed limit for vehicular traffic on
  1  9 the national system of interstate highways and on fully
  1 10 controlled-access, divided, multilaned highways is seventy
  1 11 miles per hour.  However, the department or cities political
  1 12 subdivisions with the approval of the department may establish
  1 13 a lower speed limit upon such for highways located within the
  1 14 corporate limits of a city jurisdiction of the political
  1 15 subdivision.  For the purposes of this subsection, a fully
  1 16 controlled-access highway is a highway that gives preference
  1 17 to through traffic by providing access connections with
  1 18 selected public roads only and by prohibiting crossings at
  1 19 grade or direct private driveway connections.  A minimum speed
  1 20 of forty miles per hour, road conditions permitting, is
  1 21 established on the highways referred to in this subsection.
  1 22    Sec. 2.  Section 805.8, subsection 2, paragraph g,
  1 23 subparagraph (4), Code Supplement 1995, is amended to read as
  1 24 follows:
  1 25    (4)  Notwithstanding subparagraphs (1) and (3), for
  1 26 excessive speed violations in speed zones greater than fifty-
  1 27 five miles per hour when in excess of the limit by five miles
  1 28 per hour or less the fine is ten dollars, by more than five
  1 29 and not more than ten miles per hour the fine is twenty
  1 30 dollars, by more than ten and not more than fifteen miles per
  1 31 hour the fine is forty eighty dollars, by more than fifteen
  1 32 and not more than twenty miles per hour the fine is sixty one
  1 33 hundred twenty dollars, and by more than twenty miles per hour
  1 34 the fine is sixty one hundred twenty dollars plus two dollars
  1 35 for each mile per hour of excessive speed over twenty miles
  2  1 per hour over the limit.
  2  2    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  2  3 immediate importance, takes effect upon enactment.  
  2  4                           EXPLANATION
  2  5    This bill increases the speed limit on the interstate and
  2  6 on fully controlled-access, divided, multilaned highways to 70
  2  7 miles per hour and on all other divided, multilaned highways
  2  8 to 65 miles per hour.  In addition, the bill increases the
  2  9 fines for excessive speed in speed zones that are greater than
  2 10 55 miles per hour, if the person is going more than 10 miles
  2 11 per hour over the speed limit.
  2 12    This bill is effective upon enactment.
