  1  1    Section 1.  Section 29A.27, unnumbered paragraph 8, Code
  1  2 1995, is amended to read as follows:
  1  3    All payments herein provided for in accordance with this
  1  4 section shall be paid on the approval of the adjutant general
  1  5 from the contingent fund of the executive council in
  1  6 accordance with section 29A.29.  
  1  7                           EXPLANATION
  1  8    This bill provides that the payments made by the adjutant
  1  9 general relating to the compensation, expenses, and other
  1 10 benefits of a guard member are to be paid from the state
  1 11 treasury, rather than the contingent fund of the executive
  1 12 council.  
  1 13                      BACKGROUND STATEMENT
  1 14                     SUBMITTED BY THE AGENCY
  1 15    The change made by this bill is for auditing compliance
  1 16 purposes and is recommended by the Iowa department of revenue
  1 17 and finance to resolve an inconsistency between sections
  1 18 29A.27 and 29A.29 of the Code.  According to the department,
  1 19 section 29A.29 is specific and controlling, and section 29A.27
  1 20 is obsolete.
