  1  1    Section 1.  Section 326.5, Code 1995, is amended by adding
  1  2 the following new unnumbered paragraph:
  1  3    UNNUMBERED PARAGRAPH.  The director shall exempt
  1  4 nonresidents of this state, operating upon the highways of
  1  5 this state for the purposes of having the nonresidents
  1  6 commercial vehicle repaired from the registration requirements
  1  7 of chapter 321 and the motor fuel tax requirements of chapter
  1  8 452A.  A nonresident shall be allowed to enter the corporate
  1  9 limits of a city abutting the border of this state solely for
  1 10 the purpose of repair.  A person entering the state pursuant
  1 11 to a reciprocity agreement under this section shall not be
  1 12 required to obtain a trip permit under section 326.23 or an
  1 13 interstate fuel permit under section 452A.53.
  1 14    Sec. 2.  Section 326.23, subsection 1, Code 1995, is
  1 15 amended to read as follows:
  1 16    1.  The Except as provided in section 326.5, the owner of a
  1 17 commercial vehicle which is properly registered and licensed
  1 18 in some other jurisdiction and is to be operated occasionally
  1 19 on highways in this state, may in lieu of payment of the
  1 20 annual registration fee for such vehicle obtain a trip permit
  1 21 authorizing operation of the vehicle on the highways of this
  1 22 state in interstate commerce for a period of not to exceed
  1 23 seventy-two hours.  The fee for the trip permit shall be ten
  1 24 dollars.
  1 25    Sec. 3.  Section 452A.53, unnumbered paragraph 1, Code
  1 26 1995, is amended to read as follows:
  1 27    The Except as provided in section 326.5, the advance
  1 28 arrangements referred to in the preceding section 452A.52
  1 29 shall include the procuring of a permanent interstate fuel
  1 30 permit or single trip interstate permit.
  1 31    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  1 32 immediate importance, is effective upon enactment.  
  1 33                           EXPLANATION
  1 34    This bill requires the director of the state department of
  1 35 transportation to exempt nonresidents who wish to enter the
  2  1 state and have a commercial vehicle repaired from the
  2  2 registration requirements of chapter 321 and the motor fuel
  2  3 tax requirements of chapter 452A.  The bill limits entry to
  2  4 the corporate limits of a city abutting the border of this
  2  5 state for the purposes of having the nonresidents commercial
  2  6 vehicle repaired.
  2  7    This bill is effective upon enactment.
