  1  1    Section 1.  Section 321.256, Code 1995, is amended to read
  1  2 as follows:
  1  3    321.256  OBEDIENCE TO OFFICIAL TRAFFIC-CONTROL DEVICES
  1  4 SIGNALS.
  1  5    No driver The operator of a vehicle shall not disobey the
  1  6 instructions of any an official traffic-control device signal
  1  7 placed in accordance with the provisions of this chapter,
  1  8 unless at the time, the official traffic-control signal is not
  1  9 operational or the operator is otherwise directed by a peace
  1 10 officer subject to the exceptions granted the driver operator
  1 11 of an authorized emergency vehicle.
  1 12    Sec. 2.  Section 321.257, Code 1995, is amended by adding
  1 13 the following new subsection:
  1 14    NEW SUBSECTION.  3.  A person shall not be charged with a
  1 15 violation of subsection 2 if at the time the person disobeyed
  1 16 the official traffic-control signal it was not operational.
  1 17    Sec. 3.  Section 805.8, subsection 2, paragraph h, Code
  1 18 Supplement 1995, is amended to read as follows:
  1 19    h.  For operating, passing, turning and standing violations
  1 20 under sections 321.236, subsections 3, 4, 9 and 12, 321.275,
  1 21 subsections 1 through 8, 321.295, 321.297, 321.299, 321.303,
  1 22 321.304, subsections 1 and 2, 321.305, 321.306, 321.311,
  1 23 321.312, 321.314, 321.315, 321.316, 321.318, 321.323, 321.340,
  1 24 321.344, 321.353, 321.354, 321.363, 321.365, 321.366, 321.368,
  1 25 321.382, and 321.395, the scheduled fine is fifteen dollars.
  1 26    Sec. 4.  Section 805.8, subsection 2, paragraph l, Code
  1 27 Supplement 1995, is amended to read as follows:
  1 28    l.  For violations of traffic signs and signals, and for
  1 29 failure to obey an officer under sections 321.229, 321.236,
  1 30 subsections 2 and 6, 321.256, 321.257, subsection 2, 321.294,
  1 31 321.304, subsection 3, 321.322, 321.341, 321.342, 321.343 and
  1 32 321.415, the scheduled fine is twenty dollars.
  1 33    Sec. 5.  Section 805.8, subsection 2, Code Supplement 1995,
  1 34 is amended by adding the following new paragraph:
  1 35    NEW PARAGRAPH.  z.  For violations of sections 321.341,
  2  1 321.342, 321.343, and 321.344, the scheduled fine is fifty
  2  2 dollars.  
  2  3                           EXPLANATION
  2  4    This bill amends sections 321.256 and 321.257 to provide
  2  5 that a person cannot be charged with disobeying a traffic
  2  6 signal light if it was not operational at the time of the
  2  7 occurrence.
  2  8    The bill also provides that the scheduled fine for
  2  9 violations of section 321.341, concerning obedience to a train
  2 10 signal, section 321.342, concerning stopping at certain
  2 11 railroad crossings, section 321.343, concerning the
  2 12 requirement for certain vehicles to stop at a railroad
  2 13 crossing, and section 321.344, concerning the operation of
  2 14 heavy equipment at a railroad crossing, is increased to $50.
  2 15 Under current law, the scheduled fine for violation of section
  2 16 321.344 is $15, whereas the scheduled fine for violation of
  2 17 sections 321.341 through 321.343 is $20.
