PAG LIN 1 1 Section 1. Section 331.606, subsection 1, Code 1995, is 1 2 amended to read as follows: 1 3 1. In addition to other requirements specified by law, the 1 4 recorder shall note in the fee book the date of filing of each 1 5 instrument, the number and character of the instrument, and 1 6 the name of each grantor and grantee named in the instrument. 1 7 In numbering the instruments, the recordershallmay start 1 8 with the number one immediately following the date of annual 1 9 settlement with the board and continue to number them 1 10 consecutively until the next annual settlement with the board 1 11 or the recorder may start with number one on the first working 1 12 day of the calendar year and continue to number the 1 13 instruments consecutively until the last working day of the 1 14 calendar year. 1 15 Sec. 2. Section 462A.78, subsection 1, Code Supplement 1 16 1995, is amended to read as follows: 1 17 1. a. The county recorder shall charge afiveten dollar 1 18 fee to issue a certificate of title, a transfer of title, a 1 19 duplicate, or a corrected certificate of title. 1 20b. In addition to the fee required under paragraph "a",1 21and sections 462A.82 and 462A.84, a surcharge of five dollars1 22shall be required.1 23Sec. 3. Section 462A.78, subsection 5, Code Supplement 1 24 1995, is amended to read as follows: 1 25 5. The funds collected under subsection 1, paragraph "a",1 26 shall be placed in the general fund of the county and used for 1 27 the expenses of the county conservation board if one exists in 1 28 that county.Of each surcharge collected as required under1 29subsection 1, paragraph "b", the county recorder shall remit1 30five dollars to the department of revenue and finance for1 31deposit in the general fund of the state.1 32 Sec. 4. Section 462A.84, subsection 1, paragraph b, Code 1 33 1995, is amended to read as follows: 1 34 b. The application fee for a security interest isfiveten 1 35 dollars. The fees shall be credited to the county general 2 1 fund. 2 2 Sec. 5. Section 554.9401, subsection 6, Code Supplement 2 3 1995, is amended by striking the subsection. 2 4 EXPLANATION 2 5 This bill provides a county recorder with the option of 2 6 filing instruments beginning with the number one and numbering 2 7 consecutively from the first working day of a calendar year 2 8 until the last working day of the calendar year or by filing 2 9 instruments beginning with the number one immediately after 2 10 the annual settlement with the board of supervisors and 2 11 numbering consecutively until the next annual settlement. 2 12 The bill also increases fees from $5 to $10 for 2 13 certificates of title, transfers of title, and duplicates and 2 14 for applications for security interests in titles. However, 2 15 the bill also strikes a surcharge fee of $5 which was charged 2 16 for the certificates of title and various title transactions 2 17 in addition to the $5 filing fee charged by the county 2 18 recorder for the benefit of the county general fund. The 2 19 surcharge fee was deposited in the general fund of the state. 2 20 The bill also strikes a requirement that the county recorder 2 21 remit $5 of the fee for certain uniform commercial code 2 22 filings. 2 23 LSB 4135HC 76 2 24 tj/sc/14
