  1  1    Section 1.  Section 294A.3, unnumbered paragraph 1, Code
  1  2 1995, is amended to read as follows:
  1  3    An educational excellence fund is established in the office
  1  4 of treasurer of state to be administered by the department of
  1  5 education.  Moneys appropriated by the general assembly for
  1  6 deposit in the fund shall be paid to school districts and area
  1  7 education agencies pursuant to the requirements of this
  1  8 chapter and shall be expended only to pay for increases in the
  1  9 regular compensation of teachers and other salary increases
  1 10 for teachers, to pay the costs of the employer's share of
  1 11 federal social security and Iowa public employees' retirement
  1 12 system, or a pension and annuity retirement system established
  1 13 under chapter 294, payments on the salary increases, and to
  1 14 pay costs associated with providing computer equipment or
  1 15 specialized or general training.  Moneys received by school
  1 16 districts and area education agencies shall not be used for
  1 17 pay earned by a teacher for performance of additional
  1 18 noninstructional duties.
  1 19    Sec. 2.  Section 294A.13, Code 1995, is amended to read as
  1 20 follows:
  1 21    294A.13  PHASE III PROGRAM.
  1 22    For the school year beginning July 1, 1987, and succeeding
  1 23 school years, each school district and area education agency
  1 24 that meets the requirements of this section division is
  1 25 eligible to receive moneys for the implementation under phase
  1 26 III of a performance-based pay plan or supplemental pay plan,
  1 27 or a combination of the two.
  1 28    Sec. 3.  Section 294A.14, unnumbered paragraphs 3 and 4,
  1 29 Code 1995, are amended to read as follows:
  1 30    A plan shall be developed using the procedure specified
  1 31 under section 294A.15.  The plan shall provide for the
  1 32 establishment of a performance-based pay plan, a supplemental
  1 33 pay plan, a combination of the two pay plans, or comprehensive
  1 34 school transformation programs, and shall include a budget for
  1 35 the cost of implementing the plan.  In addition to the costs
  2  1 of providing additional salary for teachers and the amount
  2  2 required to pay the employers' share of the federal social
  2  3 security and Iowa public employees' retirement system, or a
  2  4 pension and annuity retirement system established under
  2  5 chapter 294, and payments on the additional salary, the budget
  2  6 may include costs associated with providing computer equipment
  2  7 or specialized or general training.  Moneys received under
  2  8 phase III shall not be used to employ additional employees of
  2  9 a school district, except that phase III moneys may be used to
  2 10 employ substitute teachers, part-time teachers, and other
  2 11 employees needed to implement plans that provide innovative
  2 12 staffing patterns or that require that a teacher employed on a
  2 13 full-time basis be absent from the classroom for specified
  2 14 periods for fulfilling other instructional duties.  However,
  2 15 all teachers employed are eligible to receive additional
  2 16 salary under an approved plan.
  2 17    For the purpose of this section, a performance-based pay
  2 18 plan shall provide for salary increases for teachers who
  2 19 demonstrate superior performance in completing assigned
  2 20 duties.  In lieu of or in addition to salary increases
  2 21 provided under this section, a performance-based pay plan may
  2 22 provide, under an agreement with the teacher, computer
  2 23 equipment to teachers who demonstrate superior performance in
  2 24 completing assigned duties.  The value of computer equipment
  2 25 provided in lieu of or in addition to salary increases under
  2 26 this section shall be the current fair and reasonable market
  2 27 value of the equipment when ownership of the equipment is
  2 28 transferred to the teacher.  The plan shall include the method
  2 29 used to determine superior performance of a teacher.  For
  2 30 school districts, the plan may include assessments of specific
  2 31 teaching behavior, assessments of student performance,
  2 32 assessments of other characteristics associated with effective
  2 33 teaching, or a combination of these criteria.
  2 34    Sec. 4.  Section 294A.14, unnumbered paragraph 9, Code
  2 35 1995, is amended to read as follows:
  3  1    For school districts, additional instructional work
  3  2 assignments may include but are not limited to general
  3  3 curriculum planning and development, vertical articulation of
  3  4 curriculum, horizontal curriculum coordination, development of
  3  5 educational measurement practices for the school district,
  3  6 participation in assessment activities leading to
  3  7 certification by the national board for professional teaching
  3  8 standards, attendance at workshops and other programs for
  3  9 service as cooperating teachers for student teachers,
  3 10 development of plans for assisting beginning teachers during
  3 11 their first year of teaching, attendance at summer staff
  3 12 development programs, development of staff development
  3 13 programs for other teachers to be presented during the school
  3 14 year, participation in family support programs, development of
  3 15 programs which provide instruction in conflict resolution and
  3 16 mediation techniques for staff and students, development of
  3 17 anger management instructional programs for students,
  3 18 participation in school technology improvement plans, and
  3 19 other plans locally determined in the manner specified in
  3 20 section 294A.15 and approved by the department of education
  3 21 under section 294A.16 that are of equal importance or more
  3 22 appropriately meet the educational needs of the school
  3 23 district.
  3 24    Sec. 5.  NEW SECTION.  295.1  LEGISLATIVE FINDINGS AND
  3 25 INTENT.
  3 26    The general assembly finds that it is in the public
  3 27 interest to develop and equitably fund instructional
  3 28 technology within the public schools of this state to ensure
  3 29 that school students, teachers, and administrators are
  3 30 equipped and prepared to excel in the twenty-first century.
  3 31 Toward that goal, it is the intent of this chapter to
  3 32 establish and fund a school improvement technology program.
  3 33    Sec. 6.  NEW SECTION.  295.2  SCHOOL IMPROVEMENT TECHNOLOGY
  3 34 APPROPRIATION.
  3 35    1.  There is appropriated from the general fund of the
  4  1 state to the department of education for each fiscal year the
  4  2 sum of thirty million dollars for the school improvement
  4  3 technology program.
  4  4    2.  From the moneys appropriated in subsection 1, the
  4  5 amount of moneys allocated to school districts shall be in the
  4  6 proportion that the basic enrollment of a district bears to
  4  7 the sum of the basic enrollment of all districts in the state
  4  8 for the budget year.  However, for the fiscal years beginning
  4  9 July 1, 1996, and July 1, 1997, a district shall not receive
  4 10 less than fifteen thousand dollars in a fiscal year.
  4 11    3.  For each year in which an appropriation is made to the
  4 12 school improvement technology program, the department of
  4 13 education shall notify the department of revenue and finance
  4 14 of the amount to be paid to each school district based upon
  4 15 the distribution plan set forth for the appropriation made
  4 16 pursuant to this section.  The allocation to each school
  4 17 district under this section shall be made in one payment on or
  4 18 about October 15 of the fiscal year in which the appropriation
  4 19 is made, taking into consideration the relative budget and
  4 20 cash position of the state resources.  Prior to the receipt of
  4 21 funds, school districts shall provide to the department of
  4 22 education adequate assurance that they have developed or are
  4 23 developing a technology plan as required by section 295.3 and
  4 24 that funds received under this section will be used in
  4 25 accordance with the required technology plan.  However,
  4 26 approval of the plan by the department is not required.
  4 27    4.  Moneys received under this section shall not be
  4 28 commingled with state aid payments made under section 257.16
  4 29 to a school district and shall be accounted for by the local
  4 30 school district separately from state aid payments.
  4 31    5.  Payments made to school districts under this section
  4 32 are miscellaneous income for purposes of chapter 257.  Each
  4 33 local school district shall maintain a separate technology
  4 34 fund account within its budget for payments received and
  4 35 expenditures made pursuant to this section.
  5  1    6.  Moneys received under this section shall not be used
  5  2 for payment of any collective bargaining agreement or
  5  3 arbitrator's decision negotiated or awarded under chapter 20.
  5  4    Sec. 7.  NEW SECTION.  295.3  SCHOOL IMPROVEMENT TECHNOLOGY
  5  5 PLANNING.
  5  6    1.  Not later than July 1 of each school year, the board of
  5  7 directors of a school district shall adopt a technology plan
  5  8 that supports school improvement technology efforts and
  5  9 includes an evaluation component.  The plan shall focus on the
  5 10 attainment of student achievement goals under sections 280.12
  5 11 and 280.18 and shall demonstrate the manner in which the
  5 12 board, over a four-year period, will utilize technology to
  5 13 improve student achievement.  The plan shall be developed by
  5 14 licensed professional staff of the district, including both
  5 15 teachers and administrators.  The advisory committee appointed
  5 16 by the board pursuant to section 280.12, subsection 2, shall
  5 17 advise the board concerning the development of goals and the
  5 18 assessment process and measurements to be used under the plan.
  5 19 Technology plans shall be kept on file in the district and a
  5 20 copy sent to the appropriate area education agency.  Progress
  5 21 made under these plans shall be included as part of the annual
  5 22 report submitted to the department of education in compliance
  5 23 with sections 280.12 and 280.18.
  5 24    2.  If the board of directors of a school district elects
  5 25 to employ a technology director, the qualifications for the
  5 26 position shall be determined by the board.
  5 27    Sec. 8.  NEW SECTION.  295.4  SCHOOL IMPROVEMENT AND
  5 28 TECHNOLOGY EXPENDITURES.
  5 29    1.  Funds received by a school district pursuant to section
  5 30 295.2 shall be expended for the acquisition, lease, or lease-
  5 31 purchase, installation, and maintenance of instructional
  5 32 technology equipment, including hardware and software,
  5 33 materials and supplies related to instructional technology,
  5 34 and staff development and training.  Priorities for the use of
  5 35 the funds shall be made by the school district.
  6  1    2.  Funds received by a school district pursuant to section
  6  2 295.2 shall be used to supplement, not supplant, funds
  6  3 otherwise budgeted by a school district for technology
  6  4 planning and equipment, including hardware and software,
  6  5 materials, and supplies related to instructional technology
  6  6 and staff development and training.
  6  7    3.  Not more than ten percent of the total funds received
  6  8 by a school district pursuant to section 295.2 during the
  6  9 fiscal period beginning July 1, 1996, and ending June 30,
  6 10 2000, shall be used for staff development and training in the
  6 11 use of instructional technology.  
  6 12                           EXPLANATION
  6 13    This bill establishes a school improvement technology
  6 14 program and appropriates $30 million annually for the purposes
  6 15 of the program.  The bill also provides for the use of phase
  6 16 III funds for the provision of instructional technology to
  6 17 teachers in lieu of or in addition to a salary increase under
  6 18 phase III.
  6 19    The funds are appropriated to the department of education
  6 20 to be allocated to school districts in the proportion that the
  6 21 basic enrollment of a district bears to the sum of the basic
  6 22 enrollment of all districts in the state for the budget year.
  6 23 However, for the first two years of the appropriation, a
  6 24 district shall not receive less than $15,000.  The funds are
  6 25 to be used by the districts to acquire, lease, lease-purchase,
  6 26 install, and maintain instructional technology equipment,
  6 27 which the bill defines as including hardware and software,
  6 28 materials and related supplies, and staff development and
  6 29 training.
  6 30    Under the bill, funds received under the program shall not
  6 31 be used for payment of collective bargaining agreements or
  6 32 arbitrator's decisions.  Fund received under the program shall
  6 33 be used to supplement, not supplant, funds otherwise budgeted
  6 34 by a school district for instructional technology.  Not more
  6 35 than 10 percent of the total funds received in the first four
  7  1 years of the program shall be used for staff development and
  7  2 training in the use of instructional technology.
  7  3    The bill also provides that if the board of directors of a
  7  4 school district elects to employ a technology director, the
  7  5 qualifications for the job shall be determined by the board.
  7  6    Not later than July 1 of each school year, the board of
  7  7 directors of a school district is required to develop a
  7  8 technology plan that supports school improvement efforts,
  7  9 focuses on the attainment of student achievement goals, and
  7 10 demonstrates how technology will be used to improve student
  7 11 achievement and includes an evaluation component.  The plan
  7 12 shall be developed by the district's licensed professional
  7 13 staff, including both teachers and administrators.  The
  7 14 advisory committee in each district appointed pursuant to
  7 15 section 280.12, is directed to advise the board concerning the
  7 16 development of goals and the assessment process and
  7 17 measurements to be used under the plan.  The district is to
  7 18 keep a copy on file and send a copy to its area education
  7 19 agency.  Progress made under the plan shall be submitted to
  7 20 the department of education as part of the report currently
  7 21 required under sections 280.12 and 280.18.
  7 22    The bill also amends section 294A.13, which states that
  7 23 each school district and area education agency that meets the
  7 24 requirements of the section is eligible for phase III funds.
  7 25 However, the requirements are set forth in the division, and
  7 26 not in the section.  A technical correction is included in the
  7 27 bill to replace the word "section" with the word "division".
  7 28    The bill provides that participation by a teacher in a
  7 29 school improvement technology plan is an "additional work
  7 30 assignment", which would permit the payment of additional
  7 31 salary to the teacher under phase III.
