1 1 Section 1. NEW SECTION. 142C.15 ANATOMICAL GIFT
1 2 AWARENESS AND TRANSPLANTATION FUND &endash; ESTABLISHED &endash; USES OF
1 3 FUND.
1 4 1. a. An anatomical gift awareness and transplantation
1 5 fund is created as a separate fund in the state treasury under
1 6 the control of the Iowa department of public health. The fund
1 7 shall consist of moneys remitted by the county treasurer of a
1 8 county or by the department of transportation which were
1 9 collected through the payment of a contribution made by an
1 10 applicant for registration of a motor vehicle pursuant to
1 11 section 321.44A and any other contributions to the fund.
1 12 b. The moneys collected under this section and deposited
1 13 in the fund are appropriated to the Iowa department of public
1 14 health for the purposes specified in this section. Moneys in
1 15 the fund shall not be subject to appropriation or expenditure
1 16 for any other purpose.
1 17 c. The treasurer of state shall act as custodian of the
1 18 fund and shall disburse amounts contained in the fund as
1 19 directed by the department. The treasurer of state may invest
1 20 the moneys deposited in the fund. The income from any
1 21 investment shall be credited to and deposited in the fund.
1 22 Notwithstanding section 8.33, moneys in the fund are not
1 23 subject to reversion to the general fund of the state. The
1 24 fund shall be administered by the department which shall make
1 25 expenditures from the fund consistent with the purposes of
1 26 this section.
1 27 d. Moneys in the fund may be expended through grants to
1 28 any of the following persons, subject to the following
1 29 conditions:
1 30 (1) Not more than twenty percent of the moneys in the fund
1 31 annually may be expended in the form of grants to state
1 32 agencies or to nonprofit legal entities with an interest in
1 33 anatomical gift awareness and transplantation. Grants shall
1 34 be made based upon the submission of a grant application by an
1 35 agency or entity to conduct an awareness project.
2 1 (2) Not more than thirty percent of the moneys in the fund
2 2 annually may be expended in the form of grants to hospitals
2 3 for reimbursement for costs directly related to the
2 4 development of in-hospital anatomical gift awareness projects,
2 5 anatomical gift referral protocols, and associated
2 6 administrative expenses. As a condition of receiving a grant,
2 7 a hospital shall demonstrate, through documentation, that the
2 8 hospital, during the previous calendar year, properly complied
2 9 with in-hospital anatomical gift request protocols for at
2 10 least eighty percent of all deaths occurring in the hospital.
2 11 (3) Not more than fifty percent of the moneys in the fund
2 12 annually may be expended in the form of grants to hospitals
2 13 which perform heart, lung, liver, pancreas, or kidney
2 14 transplants. As a condition of receiving a grant, a hospital
2 15 shall demonstrate, through documentation, that the hospital,
2 16 during the previous calendar year, properly complied with in-
2 17 hospital anatomical gift request protocols for at least eighty
2 18 percent of all deaths occurring in the hospital. The hospital
2 19 shall submit an application on behalf of a patient requiring a
2 20 transplant in the amount of the costs associated with the
2 21 following, if funds are not available from any other third-
2 22 party payor:
2 23 (a) The costs of the organ transplantation procedure.
2 24 (b) The costs of post-transplantation drug or other
2 25 therapy.
2 26 (c) Other transplantation costs including but not limited
2 27 to food, lodging, and transportation.
2 28 Sec. 2. NEW SECTION. 142C.16 ANATOMICAL GIFT AWARENESS
2 29 ADVISORY COMMITTEE &endash; ESTABLISHED &endash; DUTIES.
2 30 1. The Iowa department of public health shall establish an
2 31 anatomical gift awareness advisory committee. Members shall
2 32 include a representative of each of the following, appointed
2 33 by the respective entity or that entity's successor:
2 34 a. A state organ procurement organization.
2 35 b. The Iowa medical society.
3 1 c. The association of Iowa hospitals and health systems.
3 2 d. The osteopathic medical association.
3 3 e. A bank or storage organization.
3 4 f. The Iowa chapter of the national association of social
3 5 workers. The representative shall be a member of the
3 6 association knowledgeable in anatomical gifts.
3 7 g. The Iowa department of public health.
3 8 h. The department of human services.
3 9 i. The department of inspections and appeals.
3 10 2. Members shall serve staggered terms of two years.
3 11 Appointments of members of the committee shall comply with
3 12 sections 69.16 and 69.16A. Vacancies shall be filled by the
3 13 original appointing authority and in the manner of the
3 14 original appointment.
3 15 3. Members shall receive actual expenses incurred while
3 16 serving in their official capacity and may also be eligible to
3 17 receive compensation as provided in section 7E.6.
3 18 4. The committee shall annually select a chairperson from
3 19 its membership. A majority of the members of the committee
3 20 shall constitute a quorum.
3 21 5. The advisory committee shall assist the department in
3 22 all of the following activities:
3 23 a. Accepting and awarding grants to promote the donation
3 24 of anatomical gifts.
3 25 b. Establishing criteria for the application for and
3 26 awarding of grants to promote the donation of anatomical
3 27 gifts.
3 28 c. Examining the anatomical gifts system to identify
3 29 improvements or enhancements to promote anatomical gifts.
3 30 d. Recommending legislation to improve state law regarding
3 31 anatomical gifts.
3 32 Sec. 3. NEW SECTION. 321.44A VOLUNTARY CONTRIBUTION &endash;
3 33 ANATOMICAL GIFT AWARENESS AND TRANSPLANTATION FUND.
3 34 For each application for registration or renewal, the
3 35 county treasurer or the department shall request through use
4 1 of a written form, and, if the application is made in person,
4 2 through verbal communication, that an applicant make a
4 3 voluntary contribution of one dollar or more to the anatomical
4 4 gift awareness and transplantation fund established pursuant
4 5 to section 142C.15. Moneys collected in the form of
4 6 contributions shall be remitted to the treasurer of state for
4 7 deposit in the fund to be used for the purposes specified for
4 8 the fund. The director shall adopt rules to administer this
4 9 section.
4 10 EXPLANATION
4 11 This bill establishes an anatomical gift awareness and
4 12 transplantation fund as a separate fund within the state
4 13 treasury under the control of the Iowa department of public
4 14 health and also establishes an anatomical gift advisory
4 15 committee within the Iowa department of public health.
4 16 The fund is to consist of moneys collected as contributions
4 17 made by applicants for registration or renewal of registration
4 18 of a motor vehicle and any other contributions to the fund.
4 19 The bill provides that the moneys in the fund are to be
4 20 distributed as grants to state agencies or nonprofit entities
4 21 for the purpose of conducting awareness projects; to hospitals
4 22 for awareness projects, referral protocols, and related
4 23 administrative expenses; and to hospitals on behalf of
4 24 patients for the costs related to transplantation.
4 25 The advisory committee is established consisting of
4 26 representatives of a state organ procurement organization, a
4 27 bank or storage organization, the Iowa medical society, the
4 28 association of Iowa hospitals and health systems, the Iowa
4 29 osteopathic medical association, the Iowa chapter of the
4 30 national association of social workers, the Iowa department of
4 31 public health, the department of human services, and the
4 32 department of inspections and appeals. The duties of the
4 33 committee include: advising the department regarding the
4 34 accepting and awarding of grants to promote anatomical gifts,
4 35 establishing criteria for the application for and awarding of
5 1 grants to promote anatomical gifts, examining the anatomical
5 2 gifts system to identify improvements or enhancements to
5 3 promote anatomical gifts, and recommending legislation to
5 4 improve state law regarding anatomical gifts.
