1 1 Section 1. Section 404.2, subsection 2, Code 1995, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. k. A county or school district in which is
1 4 located all or a portion of an urban revitalization area
1 5 designated by a city may choose not to allow an exemption for
1 6 that portion of the taxes payable to the county or school
1 7 district or may choose to allow an exemption under the
1 8 schedule set out in section 404.3, subsection 1, 2, 3, or 4.
1 9 A school district in which is located all or a portion of an
1 10 urban revitalization area designated by a county may choose
1 11 not to allow an exemption for that portion of the taxes
1 12 payable to the school district or may choose to allow an
1 13 exemption under the schedule set out in section 404.3,
1 14 subsection 1, 2, 3, or 4. A schedule chosen by a county or
1 15 school district shall not allow a greater exemption, but may
1 16 allow a smaller exemption than allowed in the schedule
1 17 specified in the corresponding subsection of section 404.3.
1 18 Sec. 2. APPLICABILITY. This Act applies to applications
1 19 for exemption filed on or after January 1, 1996.
1 20 EXPLANATION
1 21 The bill provides that, in the case of an urban
1 22 revitalization area designated by a city, a school district or
1 23 county may choose to allow no exemption from taxation or may
1 24 allow a smaller exemption under a schedule other than that
1 25 chosen by the city. In the case of a revitalization area
1 26 designated by a county, a school district may choose to allow
1 27 no exemption or may allow a smaller exemption under a schedule
1 28 other than that chosen by the county.
1 29 The bill applies to applications for property tax exemption
1 30 filed on or after January 1, 1996.
