  1  1    Section 1.  Section 321.453, Code 1995, is amended to read
  1  2 as follows:
  1  3    321.453  EXCEPTIONS.
  1  4    The provisions of this chapter governing size, weight, and
  1  5 load, and the permit requirements of chapter 321E do not apply
  1  6 to fire apparatus, to road maintenance equipment owned by or
  1  7 under lease to any state or local authority, to implements of
  1  8 husbandry temporarily moved upon a highway, to implements
  1  9 moved from farm site to farm site or between the retail seller
  1 10 and a farm purchaser within a one hundred mile radius from the
  1 11 retail seller's place of business, to indivisible implements
  1 12 of husbandry temporarily moved between the place of
  1 13 manufacture and a retail seller or a farm purchaser, to
  1 14 implements received and moved by a retail seller of implements
  1 15 of husbandry in exchange for an implement purchased, or to
  1 16 implements of husbandry moved for repairs, except on any part
  1 17 of the interstate highway system.  However, the maximum gross
  1 18 weight provisions of section 321.463 shall apply to implements
  1 19 of husbandry that are trailers.  A vehicle, carrying an
  1 20 implement of husbandry, which is exempted from the permit
  1 21 requirements under this section shall be equipped with an
  1 22 amber flashing light under section 321.423, shall be equipped
  1 23 with warning flags on that portion of the vehicle which
  1 24 protrudes into oncoming traffic, and shall only operate from
  1 25 thirty minutes prior to sunrise to thirty minutes following
  1 26 sunset.  
  1 27                           EXPLANATION
  1 28    All vehicles which are designed for agricultural purposes
  1 29 and exclusively used in the conduct of agricultural operations
  1 30 are considered implements of husbandry pursuant to chapter
  1 31 321.  This bill provides that a trailer used as an implement
  1 32 of husbandry is subject to the gross weight restrictions of
  1 33 section 321.463 despite the exceptions for implements of
  1 34 husbandry in section 321.453.  Currently, under section 321.1,
  1 35 subsection 32, paragraph "c", semitrailers converted to
  2  1 trailers for agricultural purposes are subject to section
  2  2 321.463.
