1 1 Section 1. NEW SECTION. 709C.11 FUNDING.
1 2 All costs incurred by a county pursuant to sections 709C.1
1 3 through 709C.10, including, but not limited to, the cost of
1 4 filing a sexually violent predator petition under section
1 5 709C.3, the cost of an evaluation under section 709C.4, the
1 6 cost of participating in the sexually violent predator trial
1 7 on behalf of the petitioner under section 709C.5, the cost of
1 8 court-appointed counsel for indigents under section 709C.5,
1 9 the cost of qualified experts or professionals retained under
1 10 section 709C.5, the cost of control, care, and treatment at a
1 11 facility operated by the department of human services under
1 12 section 709C.6, the cost of annual examinations under section
1 13 709C.7, the cost of representing the state in a petition for
1 14 release hearing under section 709C.8, and the cost of having
1 15 the petitioner examined by an expert or professional person
1 16 under section 709C.8, shall be paid by the state.
1 17 EXPLANATION
1 18 This bill requires the state to pay the costs incurred by a
1 19 county for services provided in sexually violent predator
1 20 cases. The costs paid will include, but are not limited to,
1 21 the cost of filing a sexually violent predator petition, the
1 22 cost of an evaluation, the cost of participating in the
1 23 sexually violent predator trial on behalf of the petitioner,
1 24 the cost of court-appointed counsel for indigents, the cost of
1 25 qualified experts or professionals who are retained, the cost
1 26 of control, care, and treatment at a facility operated by the
1 27 department of human services, the cost of annual examinations,
1 28 the cost of representing the state in a petition for release
1 29 hearing, and the cost of having the petitioner examined by an
1 30 expert or professional person.
