PAG LIN 1 1 Section 1. Section 257.1, subsection 2, Code 1995, is 1 2 amended by adding the following new unnumbered paragraph: 1 3 NEW UNNUMBERED PARAGRAPH. For the budget year commencing 1 4 July 1, 1995, the department of management shall add the 1 5 amount of the additional budget adjustment computed in section 1 6 257.14, subsection 2, to the combined foundation base. 1 7 Sec. 2. Section 257.14, unnumbered paragraph 1, Code 1995, 1 8 is amended to read as follows: 1 9 1. For the budget years commencing July 1, 1991, July 1, 1 10 1992, July 1, 1993, July 1, 1994, and July 1, 1995, if the 1 11 department of management determines that the regular program 1 12 district cost of a school district for a budget year is less 1 13 than the total of the regular program district cost plus any 1 14 adjustment added under this section for the base year for that 1 15 school district, the department of management shall provide a 1 16 budget adjustment for that district for that budget year that 1 17 is equal to the difference. 1 18 2. For the budget year beginning July 1, 1995, if the 1 19 department of management determines that the regular program 1 20 district cost plus the budget adjustment computed under 1 21 subsection 1 of a school district is less than one hundred one 1 22 percent of the total of the regular program district cost plus 1 23 any adjustment added under this section for the base year for 1 24 that school district, the department of management shall 1 25 provide an additional budget adjustment for that budget year 1 26 that is equal to the difference. 1 27 Sec. 3. Section 257.14, unnumbered paragraph 2, Code 1995, 1 28 is amended by striking the unnumbered paragraph. 1 29 Sec. 4. Section 301.1, Code 1995, is amended to read as 1 30 follows: 1 31 301.1 ADOPTION &endash; PURCHASE AND SALE. 1 32 1. The board of directors of eachand everyschool 1 33 districtis hereby authorized and empowered tomay adopt 1 34 textbooks for the teaching of allbranchessubjects that are 1 35 now or mayhereafterbe authorized to be taught in the public 2 1 schools of the state, and to contract for and buysaidthe 2 2 books and any and all other necessary school supplies atsaid2 3 the contract prices, and to sell the same. The board may sell 2 4 the textbooks and other necessary school supplies to the 2 5 pupils of their respective districts at cost, loansuch2 6 textbooks tosuchits pupils free, or rent them tosuchits 2 7 pupils atsucha reasonable fee as the board shall fix, and 2 8said moneymoneys so received shall bereturned to the general2 9fundcredited to the public school textbook reserve within the 2 10 general fund. 2 11 2. Textbooks adopted and purchased by a school district 2 12 may, and shall to the extent funds are appropriated by the2 13general assembly,be made available to pupils attending 2 14 nonpublic schools upon request of the pupil or the pupil's 2 15 parent under comparable terms as made available to pupils 2 16 attending public schools. 2 17 3. As used in thisparagraphchapter, "textbooks" means 2 18 books; instructional materials integral to a textbook series; 2 19 book substitutes, including reusable workbooks; loose-leaf or 2 20 bound manuals; and computer software materials used as book 2 21 substitutes. 2 22 Sec. 5. Section 301.4, Code 1995, is amended by striking 2 23 the section and inserting in lieu thereof the following: 2 24 301.4 FUNDING FOR TEXTBOOKS &endash; PUBLIC SCHOOLS. 2 25 1. The board of directors of each school district shall 2 26 establish a public school textbook reserve within the general 2 27 fund of the school district and annually shall credit to that 2 28 reserve all of the following: 2 29 a. Moneys collected from public school pupils for text- 2 30 books pursuant to section 301.1. 2 31 b. Moneys received by the district pursuant to chapter 257 2 32 in an amount equal to twenty dollars multiplied by the basic 2 33 enrollment of the district for the budget year, as calculated 2 34 under section 257.6. 2 35 2. Moneys in the public school textbook reserve may only 3 1 be expended for the purchase of textbooks for public school 3 2 pupils. 3 3 Sec. 6. Section 301.30, Code 1995, is amended by striking 3 4 the section and inserting in lieu thereof the following: 3 5 301.30 PAYMENTS FOR NONPUBLIC PUPILS &endash; APPROPRIATION. 3 6 Boards of directors of school districts shall provide 3 7 textbook services to nonpublic school pupils as provided in 3 8 section 301.1. Annually, there is appropriated from the 3 9 general fund of the state to the department of education an 3 10 amount equal to twenty dollars for each nonpublic school pupil 3 11 enrolled in a nonpublic school on the third Friday of 3 12 September of the previous school year. On December 15 of each 3 13 year, the department of education shall make payments to 3 14 school districts providing textbook services to nonpublic 3 15 school pupils. A school district shall receive twenty dollars 3 16 for each pupil enrolled in a nonpublic school located within 3 17 the district for which textbook services are provided. A 3 18 district providing textbook services shall credit the payments 3 19 to a nonpublic textbook reserve in the general fund in the 3 20 name of the nonpublic school for which payment was made. 3 21 The amount credited to the reserve for a nonpublic school 3 22 is equal to twenty dollars multiplied by the number of pupils 3 23 enrolled in the nonpublic school on the date provided in this 3 24 section. The nonpublic school which is provided textbook 3 25 services shall make requisition for textbook services to the 3 26 school district in which it is located. The amount of a 3 27 requisition for a nonpublic school shall not exceed the 3 28 balance of the reserve held in the name of the nonpublic 3 29 school by the school district. 3 30 Textbook services provided to nonpublic school pupils in a 3 31 district shall be comparable to the textbook services of the 3 32 school district in which the nonpublic school is located. 3 33 Payments received by a school district pursuant to this 3 34 section are miscellaneous income as defined in section 257.2 3 35 and shall not be included in the computation of district cost 4 1 under chapter 257. 4 2 Sec. 7. This Act, being deemed of immediate importance, 4 3 takes effect upon enactment and is applicable to school budget 4 4 years beginning on or after July 1, 1995. 4 5 EXPLANATION 4 6 This bill provides for a budget guarantee for school dis- 4 7 tricts for the school year beginning July 1, 1995, of 101 4 8 percent of the budget for the previous year. 4 9 This bill provides for the creation of two special textbook 4 10 reserves within the general fund of each school district for 4 11 the deposit of moneys for textbooks for public school pupils 4 12 and for nonpublic school pupils. In addition to fees and 4 13 rentals collected from public school pupils for textbooks and 4 14 school supplies, the board of directors is directed to 4 15 allocate annually to the account from moneys available to it 4 16 from the state school foundation formula an amount equal to 4 17 $20 per pupil to be used for textbook services for public 4 18 school pupils. Moneys are appropriated from the general fund 4 19 of the state to the department of education in an amount of 4 20 $20 per nonpublic school pupil for textbook services for 4 21 nonpublic school pupils. The appropriated moneys are 4 22 allocated to school districts and are deposited in each 4 23 district's nonpublic school textbook reserve for purchase of 4 24 textbook services for nonpublic school pupils. 4 25 The bill takes effect upon enactment and is applicable to 4 26 school budget years beginning on or after July 1, 1995. 4 27 LSB 1583XL 76 4 28 cl/jw/5.1
