PAG LIN 1 1 Section 1. Section 455D.3, subsection 4, Code 1995, is 1 2 amended to read as follows: 1 3 4. Solid waste management techniques. A planning area 1 4 that fails to meet the twenty-five percent goal shall 1 5 implement the following solid waste management techniques: 1 6a. Remit fifty cents per ton to the department, as of July1 71, 1995. The funds shall be deposited in the solid waste1 8account under section 455E.11, subsection 2, paragraph "a", to1 9be used in accordance with section 455E.11, subsection 2,1 10paragraph "a", subparagraph (9). Moneys under this paragraph1 11shall be remitted until such time as evidence of attainment of1 12the twenty-five percent goal is documented in subsequent1 13comprehensive plans submitted to the department.1 14b.a. Notify the public of the planning area's failure to 1 15 meet the waste volume reduction goals of this section, 1 16 utilizing standard language developed by the department for 1 17 that purpose. 1 18c.b. Develop draft ordinances which shall be used by 1 19 local governments for establishing collection fees that are 1 20 based on volume or on the number of containers used for 1 21 disposal by residents. 1 22d.c. Conduct an educational and promotional program to 1 23 inform citizens of the manner and benefits of reducing, 1 24 reusing, and recycling materials and the procurement of 1 25 products made with recycled content. The program shall 1 26 include the following: 1 27 (1) Targeted waste reduction and recycling education for 1 28 residents, including multifamily dwelling complexes having 1 29 five or more units. 1 30 (2) An intensive one-day seminar for the commercial sector 1 31 regarding the benefits of and opportunities for waste 1 32 reduction and recycling. 1 33 (3) Promotion of recycling through targeted community and 1 34 media events. 1 35 (4) Recycling notification and education packets to all 2 1 new residential, commercial, and institutional collection 2 2 service customers that include, at a minimum, the manner of 2 3 preparation of materials for collection, and the reasons for 2 4 separation of materials for recycling. 2 5 EXPLANATION 2 6 This bill amends section 455D.3, to provide that planning 2 7 areas that do not meet the July 1, 1994, waste reduction and 2 8 recycling goals are not required to remit an additional 50 2 9 cents per ton tonnage fee to the department of natural 2 10 resources. 2 11 LSB 2532HC 76 2 12 js/cf/24
