  1  1    Section 1.  Section 257.20, subsection 1, Code 1995, is
  1  2 amended to read as follows:
  1  3    1.  In order to determine the amount of instructional
  1  4 support state aid and the amount of local funding for the
  1  5 instructional support program for a district, the department
  1  6 of management shall divide the total assessed valuation in the
  1  7 state by the total budget enrollment for the budget year in
  1  8 the state to determine a state assessed valuation per pupil
  1  9 and shall divide the assessed valuation in each district by
  1 10 the district's budget enrollment for the budget year to
  1 11 determine the district assessed valuation per pupil.  The
  1 12 department of management shall multiply the ratio of the
  1 13 state's valuation per pupil to the district's valuation per
  1 14 pupil by twenty-five hundredths and subtract that result from
  1 15 one to determine the portion of the instructional support
  1 16 program budget that is local funding.  The remaining portion
  1 17 of the budget shall be funded by instructional support state
  1 18 aid.  However, for the budget year beginning July 1, 1992,
  1 19 only, the amount of state aid is three and one-quarter percent
  1 20 less than the amount computed under this paragraph for that
  1 21 budget year.
  1 22    Sec. 2.  Section 257.20, subsection 2, paragraphs a and b,
  1 23 Code 1995, are amended by striking the paragraphs.
  1 24    Sec. 3.  Section 257.20, subsection 3, Code 1995, is
  1 25 amended by striking the subsection.
  1 26    Sec. 4.  NEW SECTION.  257.50  ADDITIONAL AID FOR AT-RISK
  1 27 PUPILS.
  1 28    1.  Beginning with school budget years commencing July 1,
  1 29 1995, school districts shall receive additional state aid
  1 30 based upon the number of at-risk pupils enrolled in a public
  1 31 school in the district.  Each school district shall assist the
  1 32 department in identifying the number of at-risk pupils and the
  1 33 number shall be reported by the department to the department
  1 34 of management by October 1 of each budget year.  For purposes
  1 35 of identifying at-risk pupils, the department shall use the
  2  1 primary and secondary risk factors specified in 281 IAC 65,
  2  2 rules 4 and 5, and other risk factors that the department,
  2  3 with the approval of the department of management, shall
  2  4 specify.
  2  5    2.  The amount of additional state aid a school district
  2  6 shall receive for a budget year equals the product of one-
  2  7 tenth of one percent of the district cost per pupil for that
  2  8 budget year multiplied by the number of at-risk pupils
  2  9 identified and reported pursuant to subsection 1.
  2 10    There is appropriated from the general fund of the state to
  2 11 the department of management for each fiscal year an amount
  2 12 sufficient to pay the additional state aid to school districts
  2 13 under this section.  The additional state aid shall be paid,
  2 14 to the extent possible, in the manner provided in section
  2 15 257.16, commencing with the October 15 payment.  Aid received
  2 16 by a school district under this section shall be miscellaneous
  2 17 income.
  2 18    Sec. 5.  This Act, being deemed of immediate importance,
  2 19 takes effect upon enactment for computing state aid for school
  2 20 budget years beginning on or after July 1, 1995.  
  2 21                           EXPLANATION
  2 22    During the 1992 Session, laws were enacted that reduced the
  2 23 amount of state aid to be paid under the instructional support
  2 24 program of a school district by 3.5 percent and also, for
  2 25 subsequent years, limited the appropriations to that which was
  2 26 appropriated in 1992-1993 fiscal year.  This bill eliminates
  2 27 the freeze on the appropriation and returns the appropriation
  2 28 for the instructional support program to a standing unlimited
  2 29 appropriation.
  2 30    The bill also provides for additional state aid for school
  2 31 districts with at-risk pupils enrolled in public schools
  2 32 within the school district.  The amount of aid equals .1
  2 33 percent of the district cost per pupil times the number of at-
  2 34 risk pupils.
  2 35    The bill takes effect upon enactment and applies to school
  3  1 budget years commencing on or after July 1, 1995.
