PAG LIN 1 1 Section 1. Section 232.68, subsection 3, paragraph a, Code 1 2 1995, is amended to read as follows: 1 3 a. "Interview" means the verbal exchange between the child 1 4 and a department investigatorandor the child and an attorney 1 5 or mental health professional cooperating with the department 1 6 investigator, for the purpose of developing information 1 7 necessary to protect the child. Adepartment investigator1 8 person conducting an interview is not precluded from recording 1 9 visible evidence of abuse. 1 10 Sec. 2. Section 232.71, subsection 6, Code 1995, is 1 11 amended by adding the following new unnumbered paragraph: 1 12 NEW UNNUMBERED PARAGRAPH. The first seven hours of an 1 13 interview conducted under this subsection shall be recorded on 1 14 audio or video tape by the department investigator. Unless 1 15 notification of an investigation is withheld by court order 1 16 pursuant to subsection 1, a copy of the recorded tape shall, 1 17 immediately upon conclusion of the interview, be made 1 18 available without cost to the child's parent, guardian, or 1 19 custodian. If notification of an investigation is withheld by 1 20 court order, the recorded tape shall be made available without 1 21 cost to the child's parent, guardian, or custodian at the time 1 22 of the notification of the investigation. 1 23 EXPLANATION 1 24 This bill relates to an interview of a child alleged to be 1 25 a victim of child abuse. The bill amends one of the 1 26 definitions in chapter 232 relating to investigations of child 1 27 abuse allegations by the department of human services and the 1 28 requirements for an interview performed during confidential 1 29 access to a child. Under the bill, the first seven hours of 1 30 an interview must be recorded on video or audio tape and a 1 31 copy of the tape must be made available without charge to the 1 32 child's parent, guardian, or custodian. The tape must be made 1 33 available immediately following the interview unless 1 34 notification of the investigation has been withheld pursuant 1 35 to a court order, in which case it is to be made available at 2 1 the time of the notification. 2 2 LSB 2079HC 76 2 3 jp/cf/24
