1 1 Section 1. Section 260C.14, Code 1995, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 21. Adopt policies and procedures for the
1 4 use of the Iowa communications network as an instructional
1 5 tool at the community college. The policies and procedures
1 6 shall include, but are not limited to, the following:
1 7 a. Establishment of an hourly tuition fee of not less than
1 8 an amount equal to the average actual costs of transmitting a
1 9 course via the Iowa communications network. To determine the
1 10 actual costs of transmitting a course via the Iowa
1 11 communications network, the board shall consider at a minimum
1 12 the cost of maintenance and depreciation of classroom
1 13 equipment and equipment used at the sending and receiving
1 14 sites; the costs of instruction, including the compensation
1 15 and benefits provided to instructors; administrative fees
1 16 associated with the course offering; and a reasonable fee
1 17 related to the costs of the connection to or use of the
1 18 network by the user without state subsidy.
1 19 b. Prohibition of the transmission of a course over the
1 20 Iowa communications network to an area served by another
1 21 community college, an institution of higher learning under the
1 22 control of the state board of regents, or an accredited
1 23 private institution, which provides a substantially similar
1 24 course to the area.
1 25 Sec. 2. Section 261.9, subsection 1, Code 1995, is amended
1 26 by adding the following new paragraphs:
1 27 NEW PARAGRAPH. i. Which adopts a policy that prohibits
1 28 the transmission of a course over the Iowa communications
1 29 network to an area served by a community college, institution
1 30 of higher learning under the control of the state board of
1 31 regents, or another accredited private institution, which
1 32 provides a substantially similar course to the area.
1 33 NEW PARAGRAPH. j. Which establishes an hourly tuition fee
1 34 of not less than an amount equal to the average actual costs
1 35 of transmitting a course via the Iowa communications network.
2 1 To determine the actual costs of transmitting a course via the
2 2 Iowa communications network, the institution shall consider at
2 3 a minimum the cost of maintenance and depreciation of
2 4 classroom equipment and equipment used at the sending and
2 5 receiving sites; the costs of instruction, including the
2 6 compensation and benefits provided to instructors;
2 7 administrative fees associated with the course offering; and a
2 8 reasonable fee related to the costs of the connection to or
2 9 use of the network by the user without state subsidy.
2 10 Sec. 3. Section 262.9, Code 1995, is amended by adding the
2 11 following new subsections:
2 12 NEW SUBSECTION. 30. Adopt a policy that prohibits the
2 13 institutions of higher learning under its control from
2 14 transmitting a course over the Iowa communications network to
2 15 an area served by a community college, another institution of
2 16 higher learning under the control of the board, or an
2 17 accredited private institution, which provides a substantially
2 18 similar course to the area.
2 19 NEW SUBSECTION. 31. Direct the institutions of higher
2 20 learning under its control to establish an hourly tuition fee
2 21 of not less than an amount equal to the average actual costs
2 22 of transmitting a course via the Iowa communications network.
2 23 To determine the actual costs of transmitting a course via the
2 24 Iowa communications network, the institution shall consider at
2 25 a minimum the cost of maintenance and depreciation of
2 26 classroom equipment and equipment used at the sending and
2 27 receiving sites; the costs of instruction, including the
2 28 compensation and benefits provided to instructors;
2 29 administrative fees associated with the course offering; and a
2 30 reasonable fee related to the costs of the connection to or
2 31 use of the network by the user without state subsidy.
2 32 EXPLANATION
2 33 This bill provides that community colleges, institutions of
2 34 higher learning under the control of the state board of
2 35 regents, and accredited private institutions must adopt
3 1 policies prohibiting transmitting a course over the Iowa
3 2 communications network to an area served by another community
3 3 college, an institution under the control of the state board
3 4 of regents, or an accredited private institution, which
3 5 provides a substantially similar course to the area.
3 6 The bill also provides that community colleges,
3 7 institutions of higher learning under the control of the state
3 8 board of regents, and accredited private institutions must
3 9 establish an hourly tuition fee of not less than an amount
3 10 equal to the average actual costs of transmitting a course via
3 11 the Iowa communications network. To determine the actual
3 12 costs of transmitting a course via the Iowa communications
3 13 network, the bill directs the institutions to consider at a
3 14 minimum the costs of maintenance and depreciation of classroom
3 15 equipment and equipment used at the sending and receiving
3 16 sites; the costs of instruction, including the compensation
3 17 and benefits provided to instructors; administrative fees
3 18 associated with the course offering; and a reasonable fee
3 19 related to the costs of the connection to or use of the
3 20 network by the user without state subsidy.
