1 1 Section 1. Section 257.7, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 3. EXPENDITURE LIMITATION. A school
1 4 district shall expend at least fifty percent, but not more
1 5 than eighty-five percent, of the difference between the school
1 6 district's base year budget certified under section 24.17 and
1 7 the district's budget year budget to increase administrative
1 8 and instructional staff salaries.
1 9 Sec. 2. NEW SECTION. 295.1 SCHOOLS MAKING ADVANCES
1 10 THROUGH TECHNOLOGY PROGRAM.
1 11 In order to meet the present and future technological needs
1 12 of the children of this state, it is the intent of the general
1 13 assembly that teachers employed by, and students enrolled in,
1 14 Iowa's school districts have access to computers and computer
1 15 technology in their schools.
1 16 Sec. 3. NEW SECTION. 295.2 TECHNOLOGY ASSISTANCE TRUST
1 17 FUND.
1 18 1. A technology assistance trust fund is created in the
1 19 office of the treasurer of state under the control of the
1 20 department of education. There is appropriated to the
1 21 technology assistance trust fund for the fiscal year beginning
1 22 July 1, 1995, and ending June 30, 1996, the sum of fifteen
1 23 million dollars from the general fund of the state. There is
1 24 appropriated to the technology assistance trust fund for the
1 25 fiscal year beginning July 1, 1996, and ending June 30, 1997,
1 26 the sum of thirty million dollars from the general fund of the
1 27 state. There is appropriated to the technology assistance
1 28 trust fund for the fiscal year beginning July 1, 1997, and
1 29 ending June 30, 1998, the sum of forty-five million dollars
1 30 from the general fund of the state. There is appropriated to
1 31 the technology assistance trust fund for the fiscal year
1 32 beginning July 1, 1998, and ending June 30, 1999, the sum of
1 33 sixty million dollars from the general fund of the state.
1 34 Moneys appropriated by the general assembly for deposit in the
1 35 fund shall be paid to the school districts pursuant to the
2 1 requirements of this chapter.
2 2 2. Notwithstanding section 8.33, any unexpended or
2 3 unencumbered balances in the technology assistance trust fund
2 4 at the end of each fiscal year shall be retained in the fund
2 5 within the fund until June 30, 1999. Notwithstanding section
2 6 8.33, any unexpended or unencumbered balances remaining in the
2 7 technology assistance trust fund on June 30, 1999, shall be
2 8 carried over to the following fiscal year and be allocated by
2 9 the department of education on a competitive basis to school
2 10 districts that submit to the department technology plans for
2 11 the purposes described in subsection 3.
2 12 3. Funds in the technology assistance trust fund and the
2 13 accounts within the fund may be used for the following
2 14 purposes:
2 15 a. To purchase computers, computer networks, computer
2 16 programs, computer software, computer systems, and for
2 17 computer services as defined in section 716A.1.
2 18 b. For maintaining purchases listed under this subsection.
2 19 c. For financing for the procurement and maintenance costs
2 20 for Part III of the Iowa communications network as provided in
2 21 section 8D.13, subsection 3.
2 22 d. The costs for electronic classrooms, satellite
2 23 equipment, receiving equipment, studio and production
2 24 equipment, and other associated equipment.
2 25 e. The costs of audio, visual, or audiovisual machines,
2 26 machinery, or equipment.
2 27 4. Moneys in the technology assistance trust fund shall
2 28 not be appropriated for payment of a collective bargaining
2 29 agreement or arbitrator's decision negotiated or awarded under
2 30 chapter 20, or used for administrative or training purposes.
2 31 Sec. 4. NEW SECTION. 295.3 ALLOCATIONS AND PAYMENTS.
2 32 1. The amount of moneys allocated from the technology
2 33 assistance trust fund to each school district for each fiscal
2 34 year shall be in proportion to the basic enrollment of a
2 35 district for the budget year as defined under section 257.6 to
3 1 the sum of the basic enrollment of all districts in the state
3 2 for the budget year.
3 3 2. Commencing with the school year beginning July 1, 1995,
3 4 and for each succeeding year until June 30, 1999, the
3 5 department of education shall notify the department of revenue
3 6 and finance of the amount of technology assistance moneys to
3 7 be paid to each school district. Payments shall be made by
3 8 the department of revenue and finance on a monthly basis
3 9 commencing on October 15 and ending June 15 of each fiscal
3 10 year, taking into account the relative budget position and
3 11 cash position of the state resources. The payments shall be
3 12 separate from state aid payments made pursuant to sections
3 13 257.16 and 257.35.
3 14 3. Payments made to school districts under this chapter
3 15 are miscellaneous income for purposes of chapter 257. Each
3 16 district shall maintain a separate listing within the district
3 17 budget for payments received and expenditures made pursuant to
3 18 this chapter.
3 19 4. Each school district shall submit to the department by
3 20 June 30 a detailed report accounting for the expenditure of
3 21 moneys received pursuant to this chapter.
3 22 Sec. 5. NEW SECTION. 295.4 REPEAL.
3 23 This chapter is repealed effective July 1, 2000.
3 24 EXPLANATION
3 25 This bill establishes a schools making advancement through
3 26 technology program, creates a technology assistance trust fund
3 27 under the control of the department of education, makes an
3 28 appropriation to the fund, and provides for the distribution
3 29 of fund moneys to school districts for the purchase of
3 30 education technology.
3 31 The bill also limits a school district's use of the budget
3 32 increase that the district realizes when allowable growth is
3 33 increased. Under the bill, a school district would be
3 34 required to spend at least 50 percent, but not more than 85
3 35 percent, of the difference between the school district's base
4 1 year budget and the district's budget year budget on salary
4 2 increases for administrators and instructional staff.
4 3 The bill provides intent language that explains the
4 4 importance the general assembly places upon meeting the
4 5 present and future technological needs of the children of Iowa
4 6 and the reason for establishing the schools making advancement
4 7 through technology program.
4 8 An appropriation of $15 million from the general fund, for
4 9 the fiscal year beginning July 1, 1995, and ending June 30,
4 10 1996, is made to the technology assistance trust fund
4 11 established in the bill under the control of the department of
4 12 education. Subsequent appropriations for the following three
4 13 fiscal years are set at $30 million, $45 million, and $60
4 14 million. Moneys deposited in the fund may be used by school
4 15 districts to purchase computer equipment, software, and
4 16 systems; audio and visual equipment; for connections to the
4 17 Iowa communications network; electronic classroom equipment;
4 18 and for maintenance of the equipment listed in the bill.
4 19 Moneys in the trust fund shall not revert to the general
4 20 fund until June 30, 2000. Moneys left in the fund on June 30,
4 21 1999, shall be allocated by the department of education on a
4 22 competitive basis to school districts that submit technology
4 23 plans to the department that conform to the purposes of the
4 24 program.
4 25 Moneys in the technology assistance trust fund shall not be
4 26 appropriated for payment of a collective bargaining agreement
4 27 or arbitrator's decision negotiated or awarded under chapter
4 28 20, or used for administrative or training purposes.
4 29 The amount of moneys allocated from the technology
4 30 assistance trust fund to each school district for each fiscal
