PAG LIN 1 1 Section 1. Section 8D.13, subsection 3, Code 1995, is 1 2 amended to read as follows: 1 3 3. a. The financing for the procurement costs for the 1 4 entirety of Part I except for the communications connections 1 5 between central switching and institutions under the control 1 6 of the board of regents, and nonprofit institutions of higher 1 7 education eligible for tuition grants, and for the video, 1 8 data, and voice capacity for state agencies and for Part II 1 9 and Part III, shall be provided by the state as provided in 1 10 this subsection. The financing for the procurement and 1 11 maintenance costs for Part III shall be provided by the state.1 12A local school board, governing authority of a nonpublic1 13school, or an area education agency board may elect to provide1 14one hundred percent of the financing for the procurement and1 15maintenance costs for Part III to become part of the network.1 16 as follows: 1 17 (1)TheExcept as provided for a library or area education 1 18 agency in subparagraph (2), the basis for the amount of state 1 19 financing is one hundred percent of a single interactive audio 1 20 and interactive video connection for Part III, and such data 1 21 and voice capacity as is necessary. 1 22 (2) For a library or area education agency, the basis for 1 23 the amount of state financing is one hundred percent of the 1 24 data and voice capacity as is necessary. A library or area 1 25 education agency shall be responsible for all costs associated 1 26 with an interactive audio and interactive video connection to 1 27 the network. 1 28 b. A local school board, governing authority of a 1 29 nonpublic school, or an area education agency board may elect 1 30 to provide one hundred percent of the financing for the 1 31 procurement and maintenance costs for Part III to become part 1 32 of the network. If a school board, governing authority of a 1 33 nonpublic school, or area education agency board elects to 1 34 provide one hundred percent of the financing for the leasing 1 35 costs for Part III, the school district, school, or area 2 1 education agency may become part of the network as soon as the 2 2 network can reasonably connect the district, school, or 2 3 agency.A local school board, governing authority of a2 4nonpublic school, or an area education agency board may also2 5elect not to become part of the network.Construction of Part 2 6 III, related to a school board, governing authority of a 2 7 nonpublic school, or area education agency board which 2 8 provides one hundred percent of the financing for the leasing 2 9 costs for Part III, may proceed as determined by the 2 10 commission and consistent with the purpose of this chapter. 2 11 c. A local school board, governing authority of a 2 12 nonpublic school, or an area education agency board may also 2 13 elect not to become part of the network. 2 14 EXPLANATION 2 15 This bill provides that the state shall fund the amount of 2 16 a Part III connection for a library or area education agency 2 17 related to necessary data and voice capacity.
