PAG LIN 1 1 Section 1. Section 8D.13, subsection 12, Code 1995, is 1 2 amended to read as follows: 1 3 12. The commission, on its own or as recommended by an 1 4 advisory committee of the commission and approved by the 1 5 commission, shall permit a fee to be charged by a receiving 1 6 site to theoriginating siteoriginator of the communication 1 7 provided on the network. The fee charged shall be for the 1 8 purpose of recovering the operating costs of a receiving site. 1 9 The fee charged shall be reduced by an amount received by the 1 10 receiving site pursuant to a state appropriation for such 1 11 costs, or federal assistance received for such costs. Fees 1 12 established under this subsection shall be paid by the 1 13 originating site directly to the receiving site. For purposes 1 14 of this section, "operating costs" include the costs 1 15 associated with the management or coordination, operations, 1 16 utilities, classroom, equipment, maintenance, and other costs 1 17 directly related to providing the receiving site. 1 18 EXPLANATION 1 19 This bill provides that the fee which may be charged by a 1 20 receiving site, related to the use of the Iowa communications 1 21 network, is to be charged to the originator of the 1 22 communication rather than the originating site. 1 23 LSB 1538HC 76 1 24 mj/jj/8
