1 2 BY TEIG, ARNOLD, BRANSTAD, and SUKUP
1 3 A House Resolution to urge that the environmental
1 4 protection commission amend its proposed rules
1 5 to provide that owners of confinement feeding
1 6 operations who are subject to pending enforcement
1 7 actions, referred to the attorney general's office,
1 8 be required to obtain construction permits, to provide
1 9 for the review and enforcement of manure management
1 10 plan requirements, and to provide for the filing of
1 11 manure management plans with counties.
1 12 WHEREAS, in 1995, the Iowa General Assembly enacted
1 13 House File 519 (1995 Iowa Acts, chapter 195), which
1 14 establishes environmental standards of operation by
1 15 animal feeding operations; and
1 16 WHEREAS, House File 519 requires the department of
1 17 natural resources to adopt rules relating to the
1 18 construction of animal feeding operations; and
1 19 WHEREAS, the environmental protection commission's
1 20 proposed rules relating to animal feeding operations,
1 21 including construction permit requirements, were
1 22 published for notice and comment in the Iowa
1 23 Administrative Bulletin on November 8, 1995; NOW
1 24 THEREFORE,
1 25 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES,
1 26 That the environmental protection commission is urged
1 27 to amend its proposed rule 567 &endash; 65.6(1)(b) to
1 28 provide that a person who otherwise would not be
1 29 required to obtain a construction permit for a
1 30 confinement feeding operation, other than a small
2 1 animal feeding operation as provided in 567 &endash;
2 2 65.6(2), be required to obtain a construction permit
2 3 pursuant to House File 519 and rules adopted by the
2 4 commission, if an enforcement action, referred to the
2 5 attorney general's office, is pending against a
2 6 confinement feeding operation in which the person has
2 7 an interest; and
2 8 BE IT FURTHER RESOLVED, That the proposed rules be
2 9 amended to provide that a manure management plan
2 10 required to be submitted to the department pursuant to
2 11 House File 519 and rules adopted by the commission
2 12 also be filed with the county board of supervisors in
2 13 the county where the confinement feeding operation is
2 14 located; and
2 15 BE IT FURTHER RESOLVED, That the proposed rules be
2 16 amended to provide that a manure management plan which
2 17 is required by the commission to be submitted to the
2 18 department, but which is not filed as part of a
2 19 construction permit application, be subject to review
2 20 and enforcement by the department; and
2 21 BE IT FURTHER RESOLVED, That a copy of this
2 22 resolution be sent to the director of the department
2 23 of natural resources for presentation to the
2 24 environmental protection commission.
