1 1 Section 1. The following amendment to the Constitution of
1 2 the State of Iowa is proposed:
1 3 1. Section 3 of Article III of the Constitution of the
1 4 State of Iowa is repealed and the following adopted in lieu
1 5 thereof:
1 6 REPRESENTATIVES. SEC. 3. The members of the House of
1 7 Representatives shall be chosen every second year, by the
1 8 qualified electors of their respective districts, and their
1 9 term of office shall commence on the first day of January next
1 10 after their election, and continue two years, and until their
1 11 successors are elected and qualified. A person shall not be
1 12 elected as a Representative more than six consecutive times.
1 13 If a person is elected to serve a portion of a term to which
1 14 some other person was elected, the partial term served shall
1 15 not be included as a consecutive election.
1 16 This limitation on the number of terms shall apply to terms
1 17 of office beginning on or after January 1, 1999.
1 18 2. Section 5 of Article III of the Constitution of the
1 19 State of Iowa is repealed and the following adopted in lieu
1 20 thereof:
1 21 SENATORS &endash; QUALIFICATIONS. SEC. 5. Senators shall be
1 22 chosen for the term of four years, at the same time and place
1 23 as Representatives; they shall be twenty-five years of age,
1 24 and possess the qualifications of Representatives as to
1 25 residence and citizenship. A person shall not be elected as a
1 26 Senator more than three consecutive times. If a person is
1 27 elected to serve a portion of a term to which some other
1 28 person was elected, the partial term served shall not be
1 29 included as a consecutive election.
1 30 This limitation on the number of terms shall apply to terms
1 31 of office beginning on or after January 1, 1999.
1 32 3. Section 2 of Article IV of the Constitution of the
1 33 State of Iowa, as amended by amendment number 1 of the
1 34 Amendments of 1972 and amendment number 1 of the Amendments of
1 35 1988, is repealed and the following adopted in lieu thereof:
2 1 ELECTION AND TERM. SEC. 2. The Governor and the
2 2 Lieutenant Governor shall be elected by the qualified electors
2 3 at the time and place of voting for members of the General
2 4 Assembly. Each of them shall hold office for four years from
2 5 the time of installation in office and until a successor is
2 6 elected and qualifies. A person shall not be elected Governor
2 7 or Lieutenant Governor more than three consecutive times. If
2 8 a person succeeds to the office of Governor to serve a portion
2 9 of a term to which some other person was elected Governor, the
2 10 partial term shall not be included as a consecutive election.
2 11 If a person is elected or appointed to serve as Lieutenant
2 12 Governor for a portion of a term to which some other person
2 13 was elected or appointed Lieutenant Governor, the partial term
2 14 shall not be included as a consecutive election.
2 15 This limitation on the number of terms shall apply to terms
2 16 of office beginning on or after January 1, 1999.
2 17 4. Section 22 of Article IV of the Constitution of the
2 18 State of Iowa, as amended by amendment number 1 of the
2 19 Amendments of 1972, is repealed and the following adopted in
2 20 lieu thereof:
2 21 SECRETARY &endash; AUDITOR &endash; TREASURER. SEC. 22. A Secretary
2 22 of State, an Auditor of State and a Treasurer of State shall
2 23 be elected by the qualified electors at the same time that the
2 24 Governor is elected and for a four-year term commencing on the
2 25 first day of January next after their election, and they shall
2 26 perform such duties as may be provided by law. A person shall
2 27 not be elected Secretary of State more than three consecutive
2 28 times. A person shall not be elected Auditor of State more
2 29 than three consecutive times. A person shall not be elected
2 30 Treasurer of State more than three consecutive times. If a
2 31 person is elected or appointed to serve a portion of a term to
2 32 which some other person was elected or appointed, the partial
2 33 term shall not be included as a consecutive election.
2 34 This limitation on the number of terms shall apply to terms
2 35 of office beginning on or after January 1, 1999.
3 1 5. Section 12 of Article V of the Constitution of the
3 2 State of Iowa, as amended by amendment number 1 of the
3 3 Amendments of 1972, is repealed and the following adopted in
3 4 lieu thereof:
3 5 ATTORNEY GENERAL. SEC. 12. The General Assembly shall
3 6 provide, by law, for the election of an Attorney General by
3 7 the people, whose term of office shall be four years, and
3 8 until a successor is elected and qualifies. A person shall
3 9 not be elected Attorney General more than three consecutive
3 10 times. If a person is elected or appointed to serve a portion
3 11 of a term to which some other person was elected or appointed,
3 12 the partial term shall not be included as a consecutive
3 13 election.
3 14 This limitation on the number of terms shall apply to terms
3 15 of office beginning on or after January 1, 1999.
3 16 Sec. 2. The foregoing amendment to the Constitution of the
3 17 State of Iowa is referred to the General Assembly to be chosen
3 18 at the next general election for members of the General
3 19 Assembly and the Secretary of State is directed to cause the
3 20 same to be published for three consecutive months previous to
3 21 the date of that election as provided by law.
3 22 EXPLANATION
3 23 This joint resolution proposes an amendment to the
3 24 Constitution of the State of Iowa to provide that members of
3 25 the Iowa house of representatives shall not serve more than
3 26 six consecutive terms and members of the Iowa senate shall not
3 27 serve more than three consecutive terms. A partial term
3 28 served is not included as a consecutive election. The
3 29 limitation on the number of terms and years of service shall
3 30 only apply to terms of office beginning on or after January 1,
3 31 1999.
3 32 The resolution also provides that persons elected to the
3 33 office of governor, lieutenant governor, attorney general,
3 34 secretary of state, auditor of state, and treasurer of state
3 35 are limited to three consecutive terms of office. A partial
4 1 term served is not included as a consecutive election. The
4 2 limitation on the number of terms shall only apply to terms of
4 3 office beginning on or after January 1, 1999.
4 4 The resolution, if adopted, would be referred to the next
4 5 general assembly before being submitted to the electorate for
4 6 ratification.
