1 1 Section 1. Section 69.14A, subsection 1, paragraph a,
1 2 unnumbered paragraph 2, Code 1995, is amended to read as
1 3 follows:
1 4 However, if within fourteen days after publication of the
1 5 notice or within fourteen days after the appointment is made,
1 6 whichever is later, a petition is filed with the county
1 7 auditor requesting a special election to fill the vacancy, the
1 8 appointment is temporary and a special election shall be
1 9 called as provided in paragraph "b". The petition shall be
1 10 signed by registered voters of the county equal in number to
1 11 ten percent of the votes cast in the county for the office of
1 12 president of the United States or governor at the preceding
1 13 general election. The petition shall otherwise meet the
1 14 requirements of section 331.306, except that in counties where
1 15 supervisors are elected under plan "three", the number of
1 16 signatures calculated according to the formula in section
1 17 331.306 shall be divided by the number of supervisor districts
1 18 in the county.
1 19 Sec. 2. Section 69.14A, subsection 2, paragraph a,

1 33 EXPLANATION
1 34 A vacancy in an elective county office may be filled by
1 35 appointment or special election, subject to the determination
2 1 of the appointing authority. However, under current law, if
2 2 the office is to be filled by appointment, a special election
2 3 to fill the office shall still be held if a petition signed by
2 4 eligible electors equal in number to 10 percent of the number
2 5 of votes cast in the county for the office of president or
2 6 governor at the last preceding general election is filed. The
2 7 bill changes the petition signature requirement to registered
2 8 voters equal in number to 10 percent of the votes cast.
