PAG LIN 1 1 Section 1. Section 692.2, subsection 1, unnumbered 1 2 paragraph 1, Code Supplement 1995, is amended to read as 1 3 follows: 1 4 Except in cases in which members of the department are 1 5 participating in an investigation or arrest or as provided in 1 6 subsection 1A, the department and bureau may provide copies or 1 7 communicate information from criminal history data only to the 1 8 following: 1 9 Sec. 2. Section 692.2, Code Supplement 1995, is amended by 1 10 adding the following new subsection: 1 11 NEW SUBSECTION. 1A. The department and bureau may provide 1 12 conviction data to a person who requests the information in 1 13 writing. The request must identify the person requesting the 1 14 conviction data and must identify the person whose conviction 1 15 data is being sought by name and date of birth. 1 16 Sec. 3. Section 692.2, subsection 6, unnumbered paragraph 1 17 1, Code Supplement 1995, is amended to read as follows: 1 18 The department may charge a fee to any nonlaw-enforcement 1 19 person or agency to conduct criminal history record checks and 1 20 otherwise administer this section and other sections of the 1 21 Code providing access to criminal history records. The fee 1 22 shall be set by the commissioner of public safety equal to the 1 23 cost incurred not to exceed twenty dollars for each individual 1 24 check requested. Notwithstanding any other limitation, the 1 25 department is authorized to use revenues generated from the 1 26 fee to employ clerical personnel to process criminal history 1 27 checks for nonlaw-enforcement purposes. 1 28 EXPLANATION 1 29 This bill provides that the department of public safety's 1 30 division of criminal investigation and bureau of 1 31 identification may release criminal conviction data regarding 1 32 a person upon written request of another person. The request 1 33 must specifically identify the person whose criminal 1 34 conviction data is requested by name and date of birth and 1 35 must identify the person requesting the data. The department 2 1 may charge a person a fee to provide the data. 2 2 Conviction data is information that a person was convicted 2 3 of or plead guilty to a public offense.
