1 1 Section 1. Section 444.25A, subsection 2, Code Supplement
1 2 1995, is amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. f. That portion of a levy, the dollar
1 4 equivalent of which will be transferred into the secondary
1 5 road fund, to increase the amount transferred or provided to
1 6 the secondary road fund in the previous fiscal year in an
1 7 amount sufficient to enable the county to fully use secondary
1 8 road funds under the formula described in section 312.2,
1 9 subsection 8.
1 10 Sec. 2. Section 444.25B, subsection 2, Code Supplement
1 11 1995, is amended by adding the following new paragraph:
1 12 NEW PARAGRAPH. f. That portion of a levy, the dollar
1 13 equivalent of which will be transferred into the secondary
1 14 road fund, to increase the amount transferred or provided to
1 15 the secondary road fund in the previous fiscal year in an
1 16 amount sufficient to enable the county to fully use secondary
1 17 road funds under the formula described in section 312.2,
1 18 subsection 8.
1 19 Sec. 3. This Act applies to taxes payable in the fiscal
1 20 year beginning July 1, 1996.
1 21 EXPLANATION
1 22 This bill provides an exception to the property tax
1 23 limitation on counties for that portion of a levy for which
1 24 the dollar equivalent will be transferred into the secondary
1 25 road fund in an amount sufficient to allow the county to
1 26 receive the county's full allotment of secondary road fund
1 27 moneys. Currently, a county is allotted a portion of moneys
1 28 from the road use tax fund to the secondary road fund of the
1 29 county. Current law provides that a county which fails to
1 30 maintain a minimum local tax effort has that county's portion
1 31 of the county's secondary road fund moneys reduced. The
1 32 additional moneys are reallocated to other counties that have
1 33 maintained a minimum local tax effort based upon the needs and
1 34 area of the county.
1 35 This bill applies to taxes payable in the fiscal year
2 1 beginning July 1, 1996.
