PAG LIN 1 1 Section 1. Section 257.11, unnumbered paragraph 1, Code 1 2 Supplement 1995, is amended to read as follows: 1 3 In order to provide additional funds for school districts 1 4 which send their resident pupils to another school district or 1 5 to a community college for classes, which jointly employ and 1 6 share the services of teachers under section 280.15, which use 1 7 the services of a teacher employed by another school district, 1 8orwhich jointly employ and share the services of a school 1 9 superintendent under section 280.15 or 273.7A, or which have 1 10 established gifted and talented children programs, a 1 11 supplementary weighting plan for determining enrollment is 1 12 adopted as follows: 1 13 Sec. 2. Section 257.11, Code Supplement 1995, is amended 1 14 by adding the following new subsection: 1 15 NEW SUBSECTION. 8. GIFTED AND TALENTED CHILDREN PROGRAMS. 1 16 School districts that have established gifted and talented 1 17 children programs approved pursuant to sections 257.42 through 1 18 257.49 may receive supplementary weighting for each pupil 1 19 enrolled in the program equal to two-tenths. However, the 1 20 total additional weighting allowed under this subsection for a 1 21 budget year for a school district shall not result in 1 22 additional funding in excess of the lesser of the product of 1 23 one-fifth of the district cost per pupil multiplied by one- 1 24 twentieth of the budget enrollment, or of the amount 1 25 established by the department of management, as required in 1 26 section 257.46, to be raised from supplementary weighting. 1 27 Sec. 3. Section 257.42, unnumbered paragraph 1, Code 1995, 1 28 is amended to read as follows: 1 29 Boards of school districts, individually or jointly with 1 30 the boards of other school districts, requesting touse1 31additional allowable growthreceive supplementary weighting 1 32 for gifted and talented children programs, may annually submit 1 33 program plans for gifted and talented children programs and 1 34 budget costs, including requests foradditional allowable1 35growthsupplementary weighting for funding the programs, to 2 1 the department of education and to the applicable gifted and 2 2 talented children advisory council, if an advisory council has 2 3 been established, as provided in this chapter. 2 4 Sec. 4. Section 257.42, unnumbered paragraphs 4 and 5, 2 5 Code 1995, are amended to read as follows: 2 6 The department of education shall adopt rules under chapter 2 7 17A relating to the administration of sections 257.42 through 2 8 257.49. The rules shall prescribe the format of program plans 2 9 submitted under section 257.43 and shall require that programs 2 10 fulfill specified objectives. The department shall encourage 2 11 and assist school districts to provide programs for gifted and 2 12 talented children whether or notadditional allowable growth2 13 supplementary weighting is requested under this chapter. 2 14 The department may request that the staff of the auditor of 2 15 state conduct an independent program audit to verify that the 2 16 gifted and talented children programs funded byadditional2 17allowable growthsupplementary weighting conform to a 2 18 district's program plans. 2 19 Sec. 5. Section 257.45, subsection 1, Code 1995, is 2 20 amended to read as follows: 2 21 1. The board of directors of a school district requesting 2 22 touse additional allowable growthreceive supplementary 2 23 weighting for gifted and talented children programs shall 2 24 submit applications for approval for the programs to the 2 25 department not later than November 1 preceding the fiscal year 2 26 during which the program will be offered. The board shall 2 27 also submit a copy of the program plans to the gifted and 2 28 talented children advisory council, if an advisory council has 2 29 been established. The department shall review the program 2 30 plans and shall prior to January 15 either grant approval for 2 31 the program or return the request for approval with comments 2 32 of the department included. Any unapproved request for a 2 33 program may be resubmitted with modifications to the 2 34 department not later than a date established by the 2 35 department. Not later than February 15 the department shall 3 1 notify the department of management and the school budget 3 2 review committee of the names of the school districts for 3 3 which gifted and talented children programsusing additional3 4allowable growthreceiving supplementary weighting for funding 3 5 have been approved and the approved budget of each program 3 6 listed separately for each school district having an approved 3 7 program. 3 8 Sec. 6. Section 257.46, Code 1995, is amended to read as 3 9 follows: 3 10 257.46 FUNDING. 3 11 The budget of an approved gifted and talented children 3 12 program for a school district, after subtracting funds 3 13 received from other sources for that purpose, shall be funded 3 14 annually on a basis of one-fourth or more from the district 3 15 cost of the school district and up to three-fourths byan3 16increase in allowable growth as defined in section 257.83 17 receipt of supplementary weighting, subject to the funding 3 18 limitations in section 257.11, subsection 8, and this section. 3 19 The approved budget for a gifted and talented children program 3 20 shall not exceed an amount equal to one and twenty-four- 3 21 hundredths percent of the district cost per pupil of the 3 22 district for the base year multiplied by the budget enrollment 3 23 of the district for the budget year. Annually, the department 3 24 of management shall establisha modified allowable growththe 3 25 amount of additional funding needed to be raised from the 3 26 supplementary weighting for each such district equal to the 3 27 difference between the approved budget for the gifted and 3 28 talented children program for that district and the sum of the 3 29 amount funded from the district cost of the school district 3 30 plus funds received from other sources. 3 31 If any portion of the gifted and talented program budget 3 32 remains unexpended at the end of the budget year, the part of 3 33 the remainder equal to the proportion of the original budget 3 34 which was funded byan increase in allowable growth, as3 35defined in section 257.8supplementary weightings, shall be 4 1 carried over to the subsequent budget year and added to the 4 2 gifted and talented program budget for that year. 4 3 Sec. 7. This Act applies to school budget years commencing 4 4 on or after July 1, 1997. 4 5 EXPLANATION 4 6 Present law provides for school districts to receive 4 7 additional allowable growth to help in funding their gifted 4 8 and talented children programs. This bill substitutes the 4 9 allowable growth with supplementary weightings equal to two- 4 10 tenths of a pupil for each pupil enrolled in the gifted and 4 11 talented program. The maximum amount of additional funds that 4 12 may be raised from the supplementary weightings equals the 4 13 lesser of 20 percent of the district cost per pupil times 5 4 14 percent of budget enrollment or the amount needed to fund the 4 15 gifted and talented program. 4 16 The bill applies to school budget years commencing on or 4 17 after July 1, 1997. 4 18 LSB 3835HH 76 4 19 rn/jw/5
