PAG LIN 1 1 Section 1. Section 256.46, Code 1995, is amended to read 1 2 as follows: 1 3 256.46 RULES FOR PARTICIPATION IN EXTRACURRICULAR 1 4 ACTIVITIES BY CERTAIN CHILDREN. 1 5 The state board shall adopt rules that permit a child who 1 6 does not meet the residence requirements for participation in 1 7 extracurricular interscholastic contests or competitions 1 8 sponsored or administered by an organization as defined in 1 9 section 280.13 to participate in the contests or competitions 1 10 immediately if the child is duly enrolled in a school, is 1 11 otherwise eligible to participate, and meets one of the 1 12 following circumstances or a similar circumstance: the child 1 13 has been adopted; the child is placed under foster or shelter 1 14 care; the child is living with one of the child's parents as a 1 15 result of divorce, separation, death, or other change in the 1 16 child's parents' marital relationship; the child is a foreign 1 17 exchange student; the child has been placed in a juvenile 1 18 correctional facility; the child is a ward of the court or the 1 19 state; the child is a participant in a substance abuse or 1 20 mental health program; or the child is enrolled in an 1 21 accredited nonpublic high school because the child's district 1 22 of residence has entered into a whole grade sharing agreement 1 23 for the pupil's grade with another district. In the case of 1 24 extracurricular interscholastic contests or competitions which 1 25 require participation during the summer after regular school 1 26 classes have ended, the rules shall not require that a child 1 27 meeting one of the listed circumstances or a similar 1 28 circumstance be enrolled in a school in the school district in 1 29 which the child is residing for the summer, but the rules 1 30 shall require that the child submit evidence to the school 1 31 district in which the child is residing for the summer that 1 32 the child is duly enrolled and in good standing in the school 1 33 of the child's residence during the school year. 1 34 EXPLANATION 1 35 This bill requires the state board of education to adopt 2 1 rules under chapter 17A that specify that a child who resides 2 2 in a school district during the summer that is different from 2 3 the school district in which the child resides during the 2 4 school year may, due to certain listed special circumstances 2 5 in the child's life, participate in extracurricular 2 6 interscholastic contests or competitions in the school 2 7 district in which the child resides during the summer. 2 8 LSB 3133HH 76 2 9 kh/sc/14
