1 1 Section 1. NEW SECTION. 904.310B EMPLOYEE CANTEENS.
1 2 The director may establish a canteen at an institution
1 3 under the director's jurisdiction for the sale of items to
1 4 peace officers or employees of the institution. Inmates may
1 5 be employed at the canteen. The department may establish a
1 6 permanent operating fund for each canteen which shall consist
1 7 of receipts from the sale of items from the canteen. Any
1 8 moneys in the fund over the amount needed to conduct normal
1 9 business transactions, to reimburse any accounts which have
1 10 subsidized the canteen, and to pay employees of the canteen,
1 11 including inmate-employees, shall be used to pay for
1 12 activities held on behalf of the employees of the institution,
1 13 for employee scholarships, or for other activities or programs
1 14 which directly benefit the employees of the institution. An
1 15 employee's purchase of goods from an inmate employed in the
1 16 canteen shall not be considered a violation of section 721.12.
1 17 EXPLANATION
1 18 This bill allows the director of the Iowa department of
1 19 corrections to establish a canteen at an institution under the
1 20 director's jurisdiction for the sale of items to peace
1 21 officers or employees of the institution. The bill allows
1 22 inmates to be employed at the canteen and requires the
1 23 department to use the profit from the canteen to pay for
1 24 activities held on behalf of the employees of the institution,
1 25 for employee scholarships, or for other activities or benefits
1 26 which directly benefit the employees of the institution. The
1 27 bill provides that purchase of goods by an employee from an
1 28 inmate employed in the canteen shall not be considered a
1 29 violation of section 721.12.
1 30 The director retains the independent authority granted
1 31 under section 904.310 to establish institutional canteens.
