1 1 Section 1. NEW SECTION. 321.447 PERSONS TRANSPORTED IN
1 2 PICKUPS.
1 3 A passenger shall not stand in the open bed or sit on an
1 4 open tailgate of a pickup being operated upon a highway. An
1 5 operator shall not transport a person in violation of this
1 6 section. This section does not apply to a pickup operated as
1 7 part of a parade, a military motor vehicle, an authorized
1 8 emergency vehicle, an implement of husbandry, or a motor
1 9 vehicle used to transport hunters or hunting dogs during
1 10 hunting activities.
1 11 Sec. 2. Section 805.8, subsection 2, Code Supplement 1995,
1 12 is amended by adding the following new paragraph:
1 13 NEW PARAGRAPH. z. For a violation of section 321.447, the
1 14 scheduled fine is ten dollars.
1 15 EXPLANATION
1 16 This bill prohibits a passenger from standing in the open
1 17 bed or sitting on the open tailgate of a moving pickup and
1 18 prohibits an operator from transporting a person in violation
1 19 of the prohibition. A pickup is defined in section 321.1,
1 20 subsection 35, to mean any motor vehicle designed to carry
1 21 merchandise or freight of any kind, not to exceed 2,000
1 22 pounds. The bill does not apply to persons who are
1 23 participating in a parade, a military motor vehicle, an
1 24 authorized emergency vehicle, an implement of husbandry, or a
1 25 vehicle used for hunting. A violation carries a scheduled
1 26 fine of $10.
