1 1 Section 1. Section 455A.6, subsection 6, paragraph a, Code
1 2 1995, is amended to read as follows:
1 3 a. Establish policy for the department and adopt rules,
1 4 pursuant to chapter 17A, necessary to provide for the
1 5 effective administration of chapter 455B or 455C. Before the
1 6 commission adopts a rule, the director shall determine and
1 7 inform the commission of the following:
1 8 (1) The probable costs to the department in implementing
1 9 and enforcing the proposed rule.
1 10 (2) The probable costs to a person in complying with the
1 11 proposed rule.
1 12 EXPLANATION
1 13 This bill requires that before the environmental protection
1 14 commission adopts a rule, the director of the department of
1 15 natural resources shall determine and inform the environmental
1 16 protection commission of the probable costs to the department
1 17 in implementing and enforcing the proposed rule and of the
1 18 probable costs to a person in complying with the proposed
1 19 rule.
