PAG LIN 1 1 Section 1. Section 455B.204, subsection 1, unnumbered 1 2 paragraph 1, Code Supplement 1995, is amended to read as 1 3 follows: 1 4 An animal feeding operation structure shall belocated1 5 constructed at leastfiveone thousand two hundred fifty feet 1 6 away from an unplugged agricultural drainage well or the 1 7 surface intake of an agricultural drainage wellor; at least 1 8 five hundred feet away from a known sinkhole,; and at least 1 9 two hundred feet away from a lake, river, or stream located 1 10 within the territorial limits of the state, or any marginal 1 11 river area adjacent to the state, which can support a floating 1 12 vessel capable of carrying one or more persons during a total 1 13 of a six-month period in one out of ten years, excluding 1 14 periods of flooding. However, no distance separation is 1 15 required between a location or object and a farm pond or 1 16 privately owned lake, as defined in section 462A.2. 1 17 EXPLANATION 1 18 This bill amends section 455B.204 which places a 500 foot 1 19 separation requirement between animal feeding operations and 1 20 certain water sources, including agricultural drainage wells. 1 21 This bill provides that an animal feeding operation structure 1 22 must be constructed at least 1,250 feet away from an unplugged 1 23 agricultural drainage well or the surface intake of an 1 24 agricultural drainage well. 1 25 LSB 3530HH 76 1 26 da/jw/5
