1 1 Section 1. Section 455B.171, Code Supplement 1995, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 1A. "Earthen manure storage basin" means
1 4 the same as defined in section 455B.161.
1 5 Sec. 2. Section 455B.201, Code Supplement 1995, is amended
1 6 by adding the following new subsection:
1 7 NEW SUBSECTION. 5. A person shall not construct or expand
1 8 an earthen manure storage basin used in conjunction with a
1 9 confinement feeding operation in which swine are confined, if
1 10 the earthen manure storage basin as constructed or expanded
1 11 would have a capacity to store more than four million gallons
1 12 of waste discharge.
1 13 EXPLANATION
1 14 This bill prohibits the construction or expansion of an
1 15 earthen manure storage basin used in conjunction with a
1 16 confinement feeding operation in which swine are confined, if
1 17 the earthen manure storage basin as constructed or expanded
1 18 would have a capacity to store more than 4,000,000 gallons of
1 19 waste discharge. A person violating this section is subject
1 20 to a civil penalty of up to $5,000 is provided in section
1 21 455B.191.
